SOCIAL WELFARE (OCCUPATIONAL INJURIES) (AMENDMENT) REGULATIONS, 1971.

I, JOSEPH BRENNAN, Minister for Social Welfare, in exercise of the powers conferred on me by sections 2 and 3 of the Social Welfare Act, 1952 (No. 11 of 1952), and by sections 1 , 8 , 9 , 14 and 15 of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1971.

(2) These Regulations and the Social Welfare (Occupational Injuries) Regulations, 1967 to 1970, may be cited together as the Social Welfare (Occupational Injuries) Regulations, 1967 to 1971.

2. These Regulations shall come into operation on the 4th day of October, 1971; provided that the amount of a disablement gratuity as provided by Article 6 of these Regulations shall be payable only when the period taken into account by the assessment of the degree of disablement begins on or after the 4th day of October, 1971.

3. In these Regulations "the Principal Regulations" means the Social Welfare (Occupational Injuries) Regulations, 1967 ( S.I. No. 77 of 1967 ).

In paragraph (a) of Article 4 (2) of the Principal Regulations "five pounds and fifty new pence" is hereby substituted for "five pounds" (inserted by the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1970 ( S.I. No. 206 of 1970 ) and in paragraph (b) thereof "one pound and eightyseven new pence" is hereby substituted for "one pound and fourteen shillings" (inserted by these Regulations).

5. In paragraph (a) of Article 9 of the Principal Regulations "two pounds and seventyfive new pence", "one pound and thirtyeight new pence" and "three pounds and forty new pence" are hereby substituted for "40 shillings", "20 shillings" and "60 shillings", respectively.

6. (1) The scale set out in the Schedule to these Regulations is hereby substituted for the scale set out in the Second Schedule to the Principal Regulations (inserted by the Social Welfare (Occupational Injuries) (Amendment) Regulations, 1970).

(2) The weekly rate of pension set out in column (3) of the scale set out in the Schedule to these Regulations shall have effect on and from the 4th day of October, 1971, whether the period taken into account by the assessment began on or before or after that date.

EXPLANATORY NOTE.

The Social Welfare Act, 1971 , makes provision, inter alia, for increases in the standard weekly rates of injury benefit and of disablement pension appropriate to degrees of disablement of 20 per cent to 100 per cent.

These Regulations amend the Social Welfare (Occupational Injuries) Regulations, 1967, as amended by Social Welfare (Occupational Injuries) (Amendment) Regulations, 1969 and 1970, to provide for consequential increases in the weekly rates of injury benefit payable to persons under the age of sixteen, the amounts of disablement gratuities which are appropriate to degrees of disablement below 20 per cent and the weekly rate of pension which may be substituted for each such gratuity.
