JOINT HEALTH BOARDS (DISSOLUTION) ORDER, 1971.

The Minister for Health in exercise of the powers conferred on him by Section 45 (9) of the Health Act, 1953 (No. 26 of 1953) and Section 35 of the Health Act, 1970 (No. 1 of 1970) hereby orders as follows:—

1. This Order may be cited as the Joint Health Boards (Dissolution) Order, 1971.

2. This Order shall come into operation on the commencement of Section 35 of the Health Act, 1970 , on 1st April, 1971.

3. (1) On the coming into operation of this Order–

(a) each body named in the first column of part I of the Schedule hereto shall be dissolved,

(b) all the property, rights and liabilities of each said body shall be transferred to the relevant health board,

(c) all the holders of any office under each said body shall be transferred to a similar office under the relevant health board, which in the case of the holders of the office of secretary of each said body shall be the office of secretary of the hospital administered by that body immediately before 1st April, 1971,

(d) all contracts of a continuing character and all contracts and agreements in writing made by or with each said body and not fully executed and completed shall continue in force and have effect as if they had been made by or with the relevant health board,

(e) all legal proceedings pending at the suit of or against each said body shall continue in the name of the relevant health board, and

(f) the Orders specified in Part II of the Schedule hereto shall be revoked.

(2) The Third Schedule to the Health Act, 1970 , shall apply in relation to the dissolution of each said body and to the transfers of property, rights and liabilities, preservation of contracts, continuance of legal proceedings and transfers of officers provided for by this Order in like manner as it has effect in relation to a dissolution under Section 34 of the said Act and references in that Schedule to the commencement shall be construed as references to the commencement of this Order.

(3) In this article, "relevant health board" means, in relation to each body named in Part I of the Schedule hereto, the Board named in the said Schedule opposite thereto.

EXPLANATORY NOTE.

This Order dissolves the bodies mentioned in the first column of Part I of the Schedule to the Order and transfers all the properties, rights, liabilities and staffs of the said bodies to health boards set up under the Health Act, 1970 .

It also provides for the repeal of the orders listed in Part II of the Schedule.
