AIR NAVIGATION (RULES OF THE AIR) (AMENDMENT) ORDER, 1969.

I, BRIAN LENIHAN, Minister for Transport and Power, in exercise of the powers conferred on me by Section 5 of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows :

1. This Order may be cited as the Air Navigation (Rules of the Air) (Amendment) Order, 1969.

2. In this Order " The Principal Order " means the Air Navigation (Rules of the Air) Order, 1963 ( S.I. No. 7 of 1963 .

3. This Order shall come into operation on the 18th day of September, 1969.

4. The Air Navigation (Rules of the Air) Orders, 1963 to 1968 and this Order may be cited together as the Air Navigation (Rules of the Air) Orders, 1963 to 1969.

5. The Principal Order is hereby amended—

(a) by the insertion after the definition of " aeroplane " in Rule 1 of the Schedule of the following—

" ' aircraft ' means any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth's surface;";

(b) by the insertion after the definition of " air traffic control service " in Rule 1 of the Schedule of the following—

" ' air traffic services reporting office ' means a unit established for the purpose of receiving reports concerning air traffic services and flight plans submitted before departure;";

(c) by the insertion after the definition of " appropriate authority " in Rule 1 of the Schedule of the following—

" ' apron ' means a defined area, on a land aerodrome, intended to accommodate aircraft for the purpose of loading or unloading passengers or cargo, refuelling, parking or maintenance;";

(d) by the insertion after the definition of " manoeuvring area " in Rule 1 of the Schedule of the following—

" ' movement area ' means that part of an aerodrome intended for the surface movement of aircraft including the manoeuvring area and aprons;";

(e) by the insertion after the definition of " restricted area " in Rule 1 of the Schedule of the following—

" ' runway visual range ' means the maximum distance in the direction of take-off or landing at which the runway or the specified lights or markers delineating it can be seen from a position above a specified point on its centre line at a height corresponding to the average eye-level of pilots at touchdown;";

(f) by the substitution for the definition of " air traffic services units " in Rule 1 of the Schedule of the following—

" ' air traffic services units ' includes air traffic control units, flight information centre and air traffic services reporting office;";

(g) by the substitution for the definition of " manoeuvring area " in Rule 1 of the Schedule of the following—

" ' manoeuvring area " means that part of an aerodrome to be used for the take-off and landing of aircraft and for the movement of aircraft associated with take-off and landing but does not include aprons;";

(h) by the insertion at the end of Rule 40 (1) of the Schedule of the following—

" BRAKES

(a) Engage brakes—Raise arm and hand with fingers extended, horizontally in front of body, then clench fist.

(b) Release brakes—Raise arm, with fist clenched, horizontally in front of body, then extend fingers ".

EXPLANATORY NOTE.

This Order amends the Air Navigation (Rules of the Air) Orders, 1963 to 1968 in order to bring them into conformity with Amendment II to Annex 2 and Amendment 17 to Annex II of the Chicago Convention of 1944. The Amendments are technical and bring certain definitions into line with those fixed by the International Civil Aviation Organisation.
