GREYHOUND RACE TRACK (TOTALISATOR) (JACKPOT) REGULATIONS, 1969.

Bord na gCon, in exercise of the powers conferred on it by subsection (3) of Section 40 of the Greyhound Industry Act, 1958 (No. 12 of 1958), hereby makes the following regulations which shall constitute the terms of contract on which bets may be made and accepted on the Jackpot totalisator pool, that is to say:—

1 Definitions.

1. In these regulations:

(a) Save as otherwise provided in these regulations the words and expressions used shall have the meanings assigned to them in the Greyhound Race Track (Totalisator) (Operating) Regulations, 1960 (No. 65 of 1960);

(b) " Jackpot Pool " means a pool for nominating the winning greyhounds in five or six selected races as the operator may determine.

(c) " Net Pool " means

(i) the balance remaining after the deduction from the pool of (a) refundable, withdrawn or cancelled stakes and (b) the percentage deduction for the time being prescribed by the Board under regulations or

(ii) where a pool or part or parts of a pool is or are carried forward to a meeting as provided by Article II of these regulations, the amount mentioned in sub-paragraph (i) of this Article together with any amount or amounts carried forward in accordance with Article II.

(d) " Nomination " means the naming of a combination of greyhounds for a bet in the jackpot pool in respect of which a ticket is purchased on which the numbers of such combination may be printed, written or perforated.

(e) " to nominate " means to make such a nomination.

2 Purchase of Tickets.

2. (a) Jackpot tickets consisting of two detachable parts—(a) the ticket portion and (b) the counterfoil portion, numbered identically, may be purchased at the totalisator at a meeting where the pool is operated.

(b) Jackpot tickets referred to at sub-article (c) (i) and sub-article (c) (ii) of this Article may be purchased at the totalisator not later than two minutes prior to the " off " of the first selected race in the pool; but tickets referred to at sub-article (c) (iii) of this Article may be purchased at any time prior to the " off " of the first selected race in the pool.

(c) Jackpot tickets as follows may be purchased at the totalisator at a meeting where the pool is operated:—

(i) a single unit ticket on which the purchaser may nominate one greyhound in each selected race in the pool;

(ii) a ticket of a declared number of units on which the purchaser may nominate as many greyhounds in each selected race of the pool as provided for on such ticket; and

(iii) a combination ticket for such amount as the purchaser may wish to bet so that the purchaser may have one unit on every combination of the greyhounds nominated for each selected race of the pool.

3 Completion of Tickets.

3. (a) In the case of tickets referred to at Article 2 (c) (i) and 2 (c) (ii) of these regulations, the purchaser shall legibly insert in the appropriate spaces on the ticket the race card numbers of the greyhounds being advertised runners, which he nominates to win and shall legibly insert the same numbers on the counterfoil portion of the ticket in the spaces provided for that purpose.

(b) In the case of the combination ticket referred to at Article 2 (c) (iii) of these regulations, the purchaser shall inform the totalisator officer from whom the ticket is purchased of the nomination required, the greyhounds nominated to be advertised runners. On completion of the ticket by the totalisator officer, the ticket portion shall be retained by the operator and the purchaser shall check the counterfoil before leaving the window to ensure that his nominations are correctly entered and the operator shall not afterwards be liable for any mistakes in the completion of the ticket.

4 Posting of Tickets.

4. (a) In the case of tickets referred to at Article 2 (c) (i) and 2 (c) (ii) of these regulations, the purchaser shall detach the ticket portion and place it in the receptacle provided prior to the first race in the pool or dispose of it as may be otherwise directed by the operator.

(b) Should the counterfoil portion be inadvertently placed in the receptacle, the operator may at his discretion regard the counterfoil as a valid ticket portion.

(c) Except as provided in Article 5 of these regulations, no amendment or alteration may be made in any ticket which has been posted as aforesaid or in any completed combination ticket.

5 Excess Combinations on Ticket.

5. If the number of combinations nominated on a ticket is in excess of the number authorised by the sum bet on that ticket at the time of purchase thereof, the operator may at his discretion, deem the ticket a losing ticket or may reduce the number of combinations on the ticket in the following manner:—

(a) if more than one greyhound or combination is nominated for the selected races on a single unit ticket then the greyhounds or combinations below the one nearest the top of the columns shall be deleted;

(b) if more than the authorised number of combinations are nominated on a ticket referred to in Article 2 (c) (ii) of these regulations, then the combination or combinations in excess of the authorised number nearest the bottom of the columns shall be deleted.

6 Vacant Spaces on Tickets.

6. If any of the spaces provided on a ticket referred to in Article 2 (c) (ii) of these regulations are not used, each vacant space shall be deemed to contain the selection entered in the nearest space above in which an entry has been made for the same race.

7 Indecipherable or Ambiguous Entries.

7. (a) If in the opinion of the operator any entry made by a purchaser on a ticket is indecipherable or ambiguous the combination to which such entry relates shall be regarded as a losing one.

(b) Any combination on a ticket which includes an entry other than a number of a greyhound advertised as a runner in such race shall be regarded as a losing combination.

8 Tickets valid only at meeting where purchased.

8. Tickets purchased at a meeting may be used only at that meeting and except as provided in Article 16 of these regulations no refund of the purchase price or any part thereof shall be made.

9 Lost or mislaid Tickets.

9. The operator, his officers or servants shall not be liable if, for any reason whatsoever:—

(a) the purchaser fails to post a completed ticket as provided for by Article 4 of these regulations; or

(b) a completed ticket is lost or mislaid.

10 Dead-Heat.

10. In the event of a dead-heat for first place in any of the selected races, the dead-heating greyhounds shall be deemed the winners of that selected race.

11 No unit on winning combination or combinations.

11. If after the completion of the selected races in the pool, the winning combination or combinations are unbacked then the operator may at his discretion:—

(a) carry forward the net pool to be added either in whole or in such parts as the operator may determine to the net pool in a subsequent Jackpot Pool whether at the same or another greyhound race track; or

(b) carry forward the net pool in the manner provided in sub-paragraph (a) of this Article, less such sum as the operator may decide to distribute amongst the holders of tickets who have nominated a combination containing the winning greyhounds in such number of races in the pool as the operator may determine.

12 Calculation of Dividend.

12. The dividend shall be calculated by dividing the net pool by the total number of units on the winning combination or combinations of the selected races or in accordance with Article II (b) of these regulations if the operator so decides, where the winning combination or combinations are unbacked, on the combination or combinations containing the winning greyhounds in such number of races in the pool as the operator may determine.

13 Payment of Dividends.

13. Dividends shall be payable on presentation of the appropriate counterfoil portions of winning tickets whole and not unreasonably defaced or unrecognisable.

14 Withdrawn Greyhounds.

14. (a) If a greyhound is withdrawn from any of the selected races then the tickets bearing the number of the withdrawn greyhound shall be deemed to contain in lieu thereof, the race card number of the greyhound running in that race upon which the greatest number of units has been staked in the Totalisator Win Pool operated on that race.

(b) If an equal number of units in such Win Pool has been staked on two or more greyhounds running in that race, and if that number is greater than the number of units staked in such Win Pool on any other runner in that race, then any ticket containing the race card number of any greyhound withdrawn as aforesaid from that race, shall be deemed to contain, in lieu thereof, the numerically lowest race card number of such equally backed greyhounds.

(c) If for any reason it is, in the opinion of the operator, not possible to determine the number of the greyhound which should be substituted, every ticket containing the race card number of a greyhound withdrawn, shall be deemed to contain in lieu thereof the race card number of such greyhound as may be determined by the operator.

15 Race not run or declared a "No Race".

15. In the event of any of the selected races not being run or being declared a " no race " then the pool shall be operated on the remaining selected races.

16 Minimum number of selected races.

16. If for any reason, less than four of the selected races in the pool are run, then the pool shall be cancelled and the total amount staked in the pool at that meeting shall be refunded on presentation of the appropriate counterfoil portions of tickets whole and not unreasonably defaced or unrecognisable.

17 Express notice of Regulations.

17. Every person who bets on the Jackpot Pool shall be deemed to have express notice of these regulations and to have agreed to be bound by them and to have express notice of the Greyhound Race Track (Totalisator) Regulations, 1969, the Greyhound Race Trace (Totalisator) (Operating) Regulations, 1960, and the Greyhound Race Track (Totalisator) (Percentage) Regulations, 1964, and any amendment thereto.

18 Limitations.

18. Save, as otherwise provided in these regulations, the provisions of the Greyhound Race Track (Totalisator) (Operating) Regulations, 1960 (No. 65 of 1960), or subsequent amendments thereto, shall apply in respect of the operation of the Jackpot Pool.

19 Citation and Commencement.

19. (a) These regulations may be cited as the Greyhound Race Track (Totalisator) (Jackpot) Regulations, 1969.

(b) These regulations shall come into operation on the 20th day of June, 1969.

EXPLANATORY NOTE.

These Regulations, made by Bord na gCon, set out the conditions applicable to betting on the Jackpot Pool at the totalisators operated by the Board on licensed greyhound race tracks.
