HARBOUR RATES (KINSALE HARBOUR) ORDER, 1969.

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on my by Section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of that Act, hereby order as follows :

1. (1) This Order may be cited as the Harbour Rates (Kinsale Harbour) Order, 1969.

(2) This Order shall come into operation on the 20th day of June, 1969.

2. The Second Schedule to the Harbour Rates (Kinsale Harbour) Order, 1951 ( S.I. No. 8 of 1951 ), is hereby amended by—

(a) the substitution for the matter contained in the first, second and third columns of the Second Schedule at reference number 2 of the following—

"2.

Tonnage rates on yachts and pleasure boats

(a)

On all pleasure boats, yachts, sailing boats, motor boats, rowing boats and vessels using the harbour and not paying the composition rate in paragraph 2(b) below for each entry into the harbour for any purpose:—

(i) if under 20 tons gross, a sum of

(ii) if 20 tons gross or over but under 80 tons gross a sum of

(iii) if 80 tons gross or over

(b)

On all pleasure boats, yachts, sailing boats, motor boats, rowing boats and vessels using the harbour as a composition in full of tonnage rates payable yearly in advance on 1st July or on entry to the harbour a sum not exceeding:—

(i) if under 1 ton gross a sum of

(ii) if 1 ton gross or over but under 5 tons gross a sum of

(iii) if 5 tons gross or over but under 20 tons gross a sum of

(c)

On all pleasure boats, yachts, sailing boats, motor boats, rowing boats and vessels using the harbour and notpaying the composition rates at paragraph (b) above and remaining in the harbour after the expiration of seven days a sum not exceeding the rates specified at paragraph 2 (b) above

"

and

(b) the insertion after " Fishing Vessels " in the second column of the Second Schedule at reference number 3 of " registered as such and actively engaged in Commercial Fishing ".

EXPLANATORY NOTE.

The effect of this Order is to authorise the Kinsale Harbour Commissioners to charge revised maximum tonnage rates at Kinsale Harbour.
