GREYHOUND RACE TRACK (TOTALISATOR) REGULATIONS, 1969.

I, CHARLES J. HAUGHEY, Minister for Finance, in exercise of the powers conferred on me by section 6 (1) of the Totalisator Act, 1929 (No. 22 of 1929), hereby make the following regulations :

1. (1) These Regulations may be cited as the Greyhound Race Track (Totalisator) Regulations, 1969.

(2) These Regulations shall come into operation on the 9th day of June, 1969.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

" the Board " means Bord na gCon;

" double event " means an event in which two greyhound races taking place on the same race track are involved;

" multiple event " means an event in which more than two greyhound races taking place on the same race track are involved;

" totalisator to which these Regulations relate " means a totalisator set up on a greyhound race track.

4. No sum of less than two shillings nor any sum which is not an even multiple of sixpence shall be staked by means of a totalisator to which these Regulations relate.

5. No sum shall be staked by means of a totalisator to which these Regulations relate at any place other than at the totalisator itself.

6. (1) Where a sum is staked by means of a totalisator to which these Regulations relate, the Board shall forthwith issue to the person by whom the sum is staked a ticket (in these Regulations referred to as a totalisator ticket).

(2) Every totalisator ticket issued in respect of a sum staked on a race, double event or multiple event shall have stated thereon—

(a) the date and place of issue thereof or, code marks, identifiable by the Board, to signifiy the date and place of issue thereof, and

(b) the chance upon which the sum is staked, together with—

(i) in the case of a totalisator ticket issued in respect of a sum staked on a race or a double event—the number or numbers of the race or races and the number of the greyhound or numbers of the combination of greyhounds upon which the sum is staked, or

(ii) in the case of a totalisator ticket issued in respect of a sum staked on a multiple event—the numbers of the races upon which the sum is staked or code marks, identifiable by the Board, to signify the numbers of the races, together with either the number of a greyhound or the numbers of a combination of greyhounds upon which the sum is staked or one or more lines of blank spaces, depending on the amount staked, in which the holder may nominate his selections.

7. Not less than 80% of the total amount staked by means of a totalisator to which these Regulations relate in respect of a race (exclusive of sums so staked on a greyhound or greyhounds withdrawn and of stakes withdrawn or cancelled by the Board before the start of that race) shall be distributable amongst the holders of winning totalisator tickets issued in respect of that race.

8. (1) Not less than 80% of the total amount staked by means of a totalisator to which these Regulations relate in respect of a double event or a multiple event (exclusive of sums so staked which are repayable by the Board and of stakes withdrawn or cancelled by the Board) shall be distributable amongst the holders of winning totalisator tickets or the holders of counterfoils of winning totalisator tickets issued in respect of the event.

(2) Where there are no winning totalisator tickets in respect of a multiple event, not less than 80% of the total amount staked by means of totalisator tickets participating in the event (exclusive of sums so staked which are repayable by the Board and of stakes withdrawn or cancelled by the Board) shall be dealt with as follows :

(a) the whole thereof, or in case the Board makes a distribution under subparagraph (b) of this paragraph the amount remaining after the distribution, shall be carried forward and added, either in whole or in such parts as the Board shalldetermine, to the amount or amounts distributable at such subsequent multiple event or events, whether at a particular greyhound race track or at different greyhound race tracks, as the Board shall determine, and

(b) such portion thereof, if any, as the Board may determine shall be distributed to holders of totalisator tickets or counterfoils of totalisator tickets, as may be appropriate, issued in respect of the event who have nominated a combination of greyhounds containing the winners of such races in the event as the Board determines.

9. (1) Regulations 16, 17, 19 and 20 of the Totalisator Regulations, 1930, as amended by the Regulations mentioned in paragraph (2) of this Regulation, shall be construed as if the references to tickets included references to counterfoils of tickets for staking on a multiple event.

(2) The Regulations referred to in paragraph (1) of this Regulation are the following, namely, the Totalisator (Amendment) Regulations, 1938 ( S. R. & O. No. 134 of 1938 ), the Totalisator Regulations, 1944 ( S. R. & O. No. 195 of 1944 ), the Totalisator (Amendment) Regulations, 1956 ( S.I. No. 146 of 1956 ), the Totalisator (Multiple Event) Regulations, 1966 ( S.I. No. 7 of 1966 ), the Totalisator (Amendment) Regulations, 1967 ( S.I. No. 58 of 1967 ), and the Totalisator (Amendment) Regulations, 1968 ( S.I. No. 142 of 1968 ).

10. The Board shall cause a printed copy of these Regulations, and printed copies of any regulations for the time being in force under subsection (2) or under subsection (3) of section 40 of the Greyhound Industry Act, 1958 (No. 12 of 1958), to be kept posted up in a prominent place on or near every totalisator to which these Regulations relate while it is being worked, and every sum staked by means of a totalisator to which these Regulations relate shall be deemed to be so staked subject to and on the terms of these Regulations so far as they are relevant.

11. The Greyhound Rack Track (Totalisator) Regulations, 1960 ( S.I. No. 23 of 1960 ), are hereby revoked.
