SOCIAL WELFARE (INSURANCE INCLUSIONS AND EXCLUSIONS) REGULATIONS, 1968.

The Minister for Social Welfare in exercise of the powers conferred on him by section 3 and subsection (5) of section 4 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1968.

(2) The Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 ( S.I. No. 373 of 1952 ) and these Regulations shall be construed as one and may be cited together as the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 and 1968.

2. These Regulations shall come into operation on the 1st day of March, 1968.

3. The following paragraph shall be added to Part I of the First Schedule to the Social Welfare Act, 1952 :—

"10. Employment by the Minister for Labour as Manager of an Employment Office.".

4. The following paragraph shall be added to Part II of the First Schedule to the Social Welfare Act, 1952 :—

"11. Employment by the Minister for Labour as Manager of an Employment Office where—

( a ) the employment involves attendance for less than 18 hours in a contribution week, or

( b ) the person employed is not mainly dependent for his livelihood on the earnings derived by him from such employment.".

In accordance with section 4 (6) of the Social Welfare Act, 1952 , a draft, sanctioned by the Minister for Finance, of these Regulations was laid before, and approved by each House of the Oireachtas. The necessary Resolutions were passed by Dáil Éireann on 8th February, 1968, and by Seanad Éireann on 28th February, 1968.

EXPLANATORY NOTE.

These Regulations provide for the inclusion in the employments insurable under the Social Welfare Acts of employment as Manager of an Employment Office. Provision is also made in the Regulations to except from insurance such employment where it involves attendance for less than 18 hours in a contribution week or where the Manager is not mainly dependent on it for his livelihood.
