BROILER CHICKENS, TURKEYS AND EGGS (REGULATION OF IMPORT) ORDER, 1966.

I, CHARLES J. HAUGHEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 2 of the Agricultural Products (Regulation of Import) Act, 1938 (No. 14 of 1938), as adapted by the Agriculture (Alteration of Name of Department and Title of Minister) Order, 1965 ( S.I. No. 146 of 1965 ), hereby, after consultation with the Minister for Finance and the Minister for Industry and Commerce, order as follows :—

1. (1) This Order may be cited as the Broiler Chickens, Turkeys and Eggs (Regulation of Import) Order, 1966.

(2) This Order shall come into operation on the 1st day of July, 1966.

2. In this Order " broiler chickens " means :

(a) live domestic fowl (other than hens for slaughter, point-of-lay pullets and domestic fowl of egg-laying strains which are approaching the egg-laying stage and intended for commercial egg production) which are neither less than 2 lbs. nor more than 4 lbs. 8 ozs. in weight,

(b) carcases of domestic fowl, whether fresh, chilled or frozen, which, in case they are ovenready, are neither less than 1 lb. 8 ozs. nor more than 3 lbs. 12 ozs. in weight, or which, in any other case, are neither less than 1 lb. 12 ozs. nor more than 4 lbs. 8 ozs. in weight when plucked but uneviscerated, and

(c) parts of carcases of domestic fowl, whether fresh, chilled or frozen.

3. The importation of any poultry or other articles specified in the Schedule to this Order is hereby prohibited save under and in accordance with a licence in that behalf issued by the Minister under this Order.

4. (1) The Minister may, at his discretion, issue a licence to import a specified quantity of any poultry or other article specified in the Schedule to this Order.

(2) Whenever the Minister issues a licence under this Order he may attach to the licence any one or more of the following conditions :—

(a) a condition that the poultry or other article to which the licence relates shall be of a specified description ;

(b) a condition that such poultry or other article shall be imported within a specified time or during a specified period ;

(c) a condition that such poultry or other article shall be imported from a specified country ;

(d) a condition that such poultry or other article shall have been produced or manufactured in a specified country ;

(e) a condition that such poultry or other article shall be imported at a specified port or place or by a specified route ;

(f) a condition that such poultry or other article shall not be imported in more than a specified number of consignments ;

(g) a condition that such poultry or other article shall be imported by or on behalf of a particular person ;

(h) a condition that such poultry or other article shall be consigned from a particular person ;

(i) a condition that such poultry or other article shall be disposed of in a specified manner, for a specified purpose, or both in a specified manner and for a specified purpose.

(3) The Minister may at any time revoke any licence issued under this Order.

5. Any person who imports or attempts to import any poultry or other article specified in the Schedule in contravention of this Order or who aids or abets the importation of any such poultry or other article in contravention of this Order shall be guilty of an offence under this Order and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.

6. The provisions of this Order are in addition to, and not in substitution for, provisions of the Poultry, Poultry Carcases and Poultry Eggs (Restriction on Importation) Order, 1949 ( S.I. No. 293 of 1949 ).

SCHEDULE.

1. Broiler chickens.

2. Turkeys.

3. Carcases of turkeys and parts of such carcases, whether fresh, chilled or frozen.

4. Eggs and egg yolks, whether sweetened or unsweetened, fresh, dried or otherwise preserved, of poultry of the following descriptions, namely, domestic fowl, turkeys, ducks and geese.

5. Egg albumin.

EXPLANATORY NOTE.

The Order prohibits as from 1st July, 1966, unless under licence, the importation of broilers, turkeys, eggs and egg products.
