ELECTORAL (AMENDMENT) ACT, 1966


AN ACT TO AMEND SECTION 5 OF THE ELECTORAL ACT, 1963 . [18th January, 1966.]

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS :—

Amendment of section 5 of Electoral Act, 1963.

1.Section 5 of the Electoral Act, 1963 , shall be amended as follows:

(a) in subsection (5)—

(i) “(other than a hospital for persons suffering from mental disability)” is hereby inserted before “, sanatorium” in paragraph (i), and

(ii) in both places where they occur the words “or mental” are hereby repealed;

(b) the following subsection is hereby inserted after subsection (5):

“(5A) Where on the qualifying date, a person is a patient or inmate in any hospital or home for persons suffering from mental disability or similar institution and he is not a person in employment in the hospital, home or institution who is resident therein for the purposes of his employment, he shall be deemed for the purposes of this section to be resident in—

(a) in case the place where he would have been residing but for his having been such a patient or inmate can be ascertained by the registration authority—that place,

(b) in case the place mentioned in paragraph (a) of this subsection cannot be ascertained by the registration authority—the place where he last resided before he became such a patient or inmate.”

2.—(1) This Act may be cited as the Electoral (Amendment) Act, 1966.

(2) The Electoral Acts, 1923 to 1963, and this Act may be cited together as the Electoral Acts, 1923 to 1966.
