MUSK RATS ACT, 1933 (APPLICATION TO MINK) ORDER, 1965.

WHEREAS section 38 of the Musk Rats Act, 1933 (No. 16 of 1933), applies to the animals of the species designated mustela vison and commonly known as mink:

NOW, I, CHARLES J. HAUGHEY Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by that section and with the consent of the Minister for Finance, hereby order as follows :

1.—(1) This Order may be cited as the Musk Rats Act, 1933 (Application to Mink) Order, 1965.

(2) This Order shall come into operation on the 1st day of October, 1965.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The provisions of the Musk Rats Act, 1933 (except subsection (2) of section 10, subsection (2) of section 11, subsection (1) of section 14 and Parts III and IV) shall apply to animals of the species designated mustela vison and commonly known as mink subject to the following modifications :

(a) "after the 1st day of January, 1966," shall be inserted—

(i) in subsection (1) of section 9 after "lawful",

(ii) in subsection (1) of section 32 after "where", and

(iii) in subsection (1) of section 34 after "who", and

(b) in subsection (1) of section 34 "in the prescribed form and containing the prescribed particulars" shall be deleted.

EXPLANATORY NOTE.

The effect of this Order, which applies certain provisions of the Musk Rats Act, 1933 to mink, is to prohibit with effect from 1st January, 1966 the keeping of mink except under and in accordance with a licence from the Minister for Agriculture and Fisheries. The Order also requires that occupiers of land who know that mink, not being mink kept under licence, are to be found on such lands shall report the fact to the Minister for Agriculture and Fisheries.
