S.I. No. 68/1960 - Garda Síochána (Retirement) Regulations, 1960.


I, OSCAR TRAYNOR, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations :—

1. These Regulations may be cited as the Garda Síochána (Retirement) Regulations, 1960.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations "the principal regulations" means the Garda Síochána (Retirement) Regulations, 1934 ( S. R. & O. No. 146 of 1934 ), as amended by the Garda Síochána (Retirement) Regulations, 1951 ( S.I. No. 132 of 1951 ).

4. These Regulations apply to members of the Garda Síochána below the rank of superintendent who were members of the Garda Síochána on or before the 31st day of December, 1951, and who were granted service certificates in respect of service in the Forces prior to the 12th day of July, 1921, under the Military Service Pensions Act, 1924 (No. 48 of 1924), or the Military Service Pensions Act, 1934 (No. 43 of 1934), or the 1916 Medal or the Service (1917/1921) Medal with Bar.

5. Notwithstanding subparagraph (1) of paragraph 5 of the principal regulations and subparagraph (a) of paragraph 6 of the Garda Síochána Retirement (No. 2) Regulations, 1951 ( S.I. No. 335 of 1951 ), and subparagraph (b) of paragraph 5 of the Garda Síochána Retirement Regulations, 1955 ( S.I. No. 157 of 1955 ) the age on the attaining of which members of the Garda Síochána to whom these Regulations apply shall retire from the Garda Síochána shall be sixty-five years.

6. Subparagraph (2) of paragraph 5 of the principal regulations and subparagraph (b) of paragraph 6 of the Garda Síochána Retirement (No. 2) Regulations, 1951, shall not be applicable in the case of members of the Garda Síochána to whom these Regulations apply.

EXPLANATORY NOTE

This Order raises from 63 to 65 years the age of compulsory retirement of members of the Garda Síochána below the rank of Superintendent who hold Military Service Certificates or who have been awarded the 1916 Medal /or the (1917/21) Medal with Bar. This extends to the ranks mentioned the arrangement already approved for Superintendents and Chief Superintendents.
