BOVINE TUBERCULOSIS (CLEARANCE AREA) (SPECIAL CONTROLS) (AMENDMENT) ORDER, 1960.

I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), order as follows:

1.—(1) This Order may be cited as the Bovine Tuberculosis (Clearance Area) (Special Controls) (Amendment) Order, 1960.

(2) This Order shall come into operation on the 1st day of November, 1960.

2. In this Order, "the Principal Order" means the Bovine Tuberculosis (Clearance Area) (Special Controls) Order, 1960 ( S.I. No. 178 of 1960 ).

3. In the definition of "the area" contained in Article 2 of the Principal Order, there is hereby inserted "and the administrative counties of Clare, Galway, Leitrim and Roscommon, those parts of the administrative county of Limerick and the county borough of Limerick lying north of the River Shannon and that part of the administrative county of Westmeath lying west of that river" after "Sligo."

4. The following paragraph is hereby substituted for paragraph (4) of Article 4 of the Principal Order—

"(4) where cattle referred to in subparagraph (f) of paragraph (1) of this Article are being moved into the area under permit under this Article, the person in charge of the cattle shall have in his possession—

(a) where the test was carried out in the State—

(i) a tuberculin test certificate (export) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(ii) a market clearance certificate in respect of the cattle,

(b) where the test was carried out in Northern Ireland, a certificate issued by the veterinary surgeon who carried out the test, certifying that the cattle have passed that test."

5. The following subparagraph is hereby substituted for subparagraph (c) of paragraph (5) of Article 6 of the Principal Order—

"(c) where cattle referred to in subparagraph (f) of paragraph (2) of this Article are being moved into a clear herd, the person in charge of the cattle shall have in his possession—

(i) where the test was carried out in the area—

(I) a tuberculin test certificate (export) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(II) a tuberculin test certificate (domestic) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(III) a market clearance certificate in respect of the cattle,

(ii) where the test was carried out elsewhere in the State—

(I) a tuberculin test certificate (export) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(II) a market clearance certificate in respect of the cattle,

(iii) where the test was carried out in Northern Ireland, a certificate issued by the veterinary surgeon who carried out the test, certifying that the cattle have passed that test."

6. The following paragraph is hereby substituted for paragraph (5) of Article 10 of the Principal Order—

"(5) where cattle referred to in subparagraph (f) of paragraph (2) of Article 9 of this Order are exposed at a public sale of cattle in the area, the person in charge of the cattle shall have in his possession—

(a) where the test was carried out in the area—

(i) a tuberculin test certificate (export) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(ii) a tuberculin test certificate (domestic) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(iii) a market clearance certificate in respect of the cattle,

(b) where the test was carried out elsewhere in the State—

(i) a tuberculin test certificate (export) issued under the Bovine Tuberculosis (14-Day Test) Order, 1960, or

(ii) a market clearance certificate in respect of the cattle,

(c) where the test was carried out in Northern Ireland, a certificate issued by the veterinary surgeon who carried out the test, certifying that the cattle have passed that test."

7. Subparagraph (f) of paragraph (1) of Article 4, subparagraph (f) of paragraph (2) of Article 6 and subparagraph (f) of paragraph (2) of Article 9 of the Principal Order are each hereby amended by the deletion of "the Bovine Tuberculosis (14-Day Test) Orders, 1958 to 1960, or" and by the substitution of "that order" for "those Orders."

8. The Bovine Tuberculosis (Control of Public Sales of Cattle) Order, 1960 ( S.I. No. 180 of 1960 ), the Bovine Tuberculosis (Movement Control) Order, 1960 ( S.I. No. 179 of 1960 ), and the Bovine Tuberculosis (Control of Public Sales of Cattle) (Counties of Sligo, Clare, Galway, Leitrim, Roscommon, Donegal and Mayo) Order, 1959 ( S.I. No. 110 of 1959 ), are hereby revoked.

EXPLANATORY NOTE.

This Order extends, with effect from 1st November, 1960, to Counties Clare, Galway, Leitrim, Roscommon, the parts of County Limerick and the County Borough of Limerick lying north of the River Shannon and the part of County Westmeath lying west of that River the provisions of the Bovine Tuberculosis (Clearance Area) (Special Controls) Order, 1960, which prohibits movement of cattle, except under permit, into Counties Donegal, Mayo and Sligo, specifies the classes of cattle for which such permits shall be granted, regulates movement of cattle into and out of herds and specifies the classes of cattle which may be exposed at public sales held in these counties.
