THE INSTITUTION OF CIVIL ENGINEERS OF IRELAND (CHARTER AMENDMENT) ACT, 1960.


AN ACT TO AMEND THE CHARTER UNDER WHICH THE INSTITUTION OF CIVIL ENGINEERS OF IRELAND IS INCORPORATED SO AS TO EXTEND THE OBJECTS OF THE INSTITUTION AND TO ALTER THE PROVISIONS RELATING TO THE MEMBERSHIP OF THE COUNCIL THEREOF. [24th March, 1960.]

Preamble.

WHEREAS the Institution of Civil Engineers of Ireland was founded many years prior to the year 1877 for promoting the acquisition of that species of knowledge which appertains to the professions of Civil and Mechanical Engineers and for the general advancement of Engineering and Mechanical Science.

AND WHEREAS by a Charter or Letters Patent under the Great Seal of Ireland bearing date the 15th day of October 1877, and granted by her late Majesty Queen Victoria certain persons therein named and such other persons as were then or should at any time thereafter become members of the said Institution were incorporated into one body politic and corporate by the name of “The Institution of Civil Engineers of Ireland” for the purposes of promoting the acquisition of that species of knowledge which appertains to the professions of Civil and Mechanical Engineers and for the special advancement of Engineering and Mechanical Science and by the Charter certain powers were conferred upon the Corporation and certain provisions were made for the general regulation and management of the affairs of the Institution.

AND WHEREAS by reason of the growth and development of other branches of Engineering Science which are not within the objects of the Institution as set forth in the Charter it is expedient that the objects of the Institution should be extended as hereinafter provided.

AND WHEREAS it is also expedient that the provisions of the Charter relating to the membership of the Council of the Institution should be altered as provided by this Act.

AND WHEREAS the purposes aforesaid cannot be effected without the authority of the Oireachtas.

BE IT THEREFORE ENACTED BY THE OIREACHTAS AS FOLLOWS:—

Definition.

1. In this Act unless the context otherwise requires:—

The expression “the Charter” means the Royal Charter of Incorporation of the Institution of Civil Engineers of Ireland granted on the 15th day of October 1877.

The expression “the Institution” means the body corporate constituted by the Charter.

Extension of power to cover the profession of engineering and for special advancement of engineering sciences.

2. So much of the Charter as provides that the purposes of the Institution shall be for promoting the acquisition of that species of knowledge which appertains to the profession of Civil and Mechanical Engineers and for the special advancement of Engineering and Mechanical Science shall be construed as if it provided that the purposes of the Institution shall be for promoting the acquisition of that species of knowledge which appertains to the profession of Engineering and for the special advancement of Engineering sciences.

By-Laws to prescribe maximum number of members of the Council.

3. Notwithstanding anything contained in the Charter,

(1) the By-Laws of the Institution may from time to time prescribe a maximum number of members of the Council (other than and exclusive of the President, the Vice-Presidents, and the Secretary), and that from and after the enactment of any such By-Law the number of members of the Council (other than and exclusive of the President, the Vice-Presidents and the Secretary) shall not be more than the maximum so prescribed nor less than twenty-one;

(2) the By-Laws of the Institution may from time to time prescribe that a certain number (not being less than four) of the members of the Council shall be Past-Presidents of the Institution to be appointed by the Council from time to time, in accordance with such By-Laws, to act as members of the Council and so that the Past-Presidents so appointed shall, while they hold office under such appointments, be deemed to be members of the Council for the purpose of computing the maximum and minimum numbers and for all other purposes. Provided always that if at any time the number of Past-Presidents able and willing to act as members of the Council shall be less than four the minimum number of Past-Presidents so to be appointed shall be reduced to the number of Past-Presidents as are able and willing to act.

Council to have management of affairs of Institution.

4. The Council, consisting of the President, the Vice-Presidents, the Secretary, and not more than the maximum number for the time being prescribed by the By-Laws, nor less than twenty-one other members, constituted in accordance with this Act shall have the direction and management of the concerns of the Institution and the rights and duties conferred on the Council in accordance with the Charter.

Pending election of members present Council to have full power and jurisdiction.

5. Pending the result of the election of members of the Council as constituted under the provisions of this Act, the Council as at present constituted shall have full power and jurisdiction in the management of the affairs of the Institution as provided in the Charter.

Confirmation of Charter in other respects.

6. Save as hereby amended and extended, the Charter shall remain in full force and effect.

Provision for expenses of amendment of Charter.

7. The cost charges and expenses preliminary to and of and incidental to the preparing, obtaining and passing of this Act shall be paid by the Institution out of the funds of the Institution.

Short title.

8. This Act may be cited as the Institution of Civil Engineers of Ireland (Charter Amendment) Act, 1960.
