POST OFFICE SAVINGS BANK REGULATIONS, 1921 (AMENDMENT) REGULATIONS, 1959.

I, SEÁN ORMONDE, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 11 of the Post Office Savings Bank Act, 1861, as amended by subsection (2) of section 5 of the Savings Banks Act, 1958 (No. 23 of 1958), and with the consent of the Minister for Finance, hereby make the following regulations with respect to which a draft has been laid before each House of the Oireachtas and no action against the draft or any part thereof has been taken by either such House :

1. These Regulations may be cited as the Post Office Savings Bank Regulations, 1921 (Amendment) Regulations, 1959.

2. These Regulations shall come into operation on the 9th day of April, 1959.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. In these Regulations " the Principal Regulations " means the Post Office Savings Bank Regulations, 1921 (S. R. & O. No. 1532 of 1921).

5. The following Regulation is hereby substituted for Regulation 18 of the Principal Regulations :

" 18. (1) Subject to the provision of these Regulations, the declaration to be required from a depositor on opening an account in the Post Office Savings Bank shall be a declaration—

(a) which, except in cases where these Regulations provide otherwise, is made by the depositor, and

(b) which declares whether the depositor has or has not any other account in the Post Office Savings Bank, including any joint account in which his name appears and any account opened in trust for him, and sets forth the particulars of any such account.

(2) The person making the declaration aforesaid shall, at the time of such making, give the Minister a statement of his full name or names, address and occupation together with a specimen of his signature and shall, whenever subsequently requested so to do by the Minister, give the Minister a specimen of his signature.

(3) This Regulation shall not apply where an account is opened by or under the authority of a statute which dispenses with the making of the declaration or where the Minister directs that the making of the declaration is unnecessary.

(4) In this Regulation ' the Minister ' means the Minister for Posts and Telegraphs."

6. Regulations 15, 16 and 17 of the Principal Regulations are hereby revoked.

EXPLANATORY NOTE.

Before the passing of the Savings Banks Act, 1958 , a depositor could have only one account in the Post Office Savings Bank or Trustee Savings Banks. The Act removed this restriction and necessitated the amendment of the form of declaration prescribed in the Post Office Savings Bank Regulations, 1921, to be made by a depositor on opening an account.
