TRANSPORT ACT, 1950 (ADDITIONAL POWERS) ORDER, 1959.

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by section 14 of the Transport Act, 1950 (No. 12 of 1950), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), with the consent of the Minister for Finance, hereby order as follows :

1. This Order may be cited as the Transport Act, 1950 (Additional Powers) Order, 1959.

2. In this Order " the railway " means the railway lines and sidings constructed under subparagraph (f) of paragraph (1) of Article 3 of the Cork Harbour Works Order, 1956 ( S.I. No. 198 of 1956 ), by the Cork Harbour Commissioners on the rebuilt and extended quays at Cork Harbour and the railway lines laid under that subparagraph by the said Commissioners across the public road.

3. Córas Iompair Éireann may work the railway locomotives or engines propelled by steam or any other motive power.

4. The provisions of the Railways Clauses Consolidation Act, 1845, or of any other enactment, with respect to the crossing of roads or other interference therewith or with respect to works for the accommodation of lands adjoining a railway shall not apply to the railway.

5. The railway shall not be opened for traffic until it has been inspected and certified to be fit for traffic by an Inspector duly appointed under the Regulation of Railways Act, 1871.
