DUBLIN PUBLIC ASSISTANCE AUTHORITIES (HEALTH FUNCTIONS) ORDER, 1958.

The Minister for Health, in exercise of the powers conferred on him by sections 45 and 46 of the Health Act, 1953 (No. 26 of 1953) and section 7 of the Health Act, 1947 (No. 28 of 1947), hereby orders as follows :—

1. This order may be cited as the Dublin Public Assistance Authorities (Health Functions) Order, 1958.

2. In this order, " the principal order " means the Dublin Public Assistance Authorities (Health Functions) Order, 1954 ( S.I. No. 162 of 1954 ) as amended by the Dublin Public Assistance Authorities (Health Functions) Order, 1956 ( S.I. No. 72 of 1956 ).

3. This order shall come into operation on the 29th day of December, 1958.

4. The principal order shall be amended by—

(a) the substitution in paragraph (c) of the definition of " specified institutional services " in article 2 of " either in a hospital or home maintained by the board or in an extern institution such as is referred to in paragraph (b) of this definition " for " in a hospital or home maintained by the board ".

(b) the substitution of " (as amended by the Health Act, 1954 , the Health and Mental Treatment Act, 1957 , and the Health and Mental Treatment (Amendment) Act, 1958 ) " for " (as amended by the Health Act, 1954 ) " in the First Schedule ;

(c) the addition to the First Schedule of the following :

" Section 65 (subject to the limitation that subsection (1) shall apply only in relation to a service which is similar or ancillary to a service which the board are authorised to operate in pursuance of section 45 or section 46 of the Act) " ;

(d) the substitution of the following paragraphs for paragraphs 3 and 3A of the Second Schedule :

" 3. The General Institutional and Specialist Services Regulations, 1954, ( S.I. No. 100 of 1954 ), as amended by—

(i) the General Institutional and Specialist Services (Amendment) Regulations, 1955 ( S.I. No. 47 of 1955 ),

(ii) the General Institutional and Specialist Services (Amendment) Regulations, 1956 ( S.I. No. 43 of 1956 ), and

(iii) the General Institutional and Specialist Services (Amendment) Regulations, 1958 ( S.I. No. 266 of 1958 ).

3A. Parts I and II of the Maternity and Child Health Services Regulations, 1954 ( S.I. No. 98 of 1954 ), as amended by—

(i) the Maternity and Child Health Services (Amendment) Regulations, 1954 ( S.I. No. 158 of 1954 ),

(ii) the Maternity and Child Health Services (Amendment) Regulations, 1955 ( S.I. No. 48 of 1955 ),

(iii) the Maternity and Child Health Services (Amendment) Regulations, 1956 ( S.I. No. 44 of 1956 ), and

(iv) the Maternity and Child Health Services (Amendment) Regulations, 1958 ( S.I. No. 265 of 1958 ) ".

5. (1) The Corporation of Dublin and the Council of the County of Dublin are hereby authorised to act jointly, in respect of the Dublin Public Assistance District, in the performance of their functions under Part I of the Children Act, 1908 (as amended) and under the Children (Amendment) Act, 1957 (No. 28 of 1957), and such joint action shall be carried out by the Dublin Board of Assistance.

(2) The Balrothery Board of Assistance are hereby authorised to perform, in respect of the Balrothery Public Assistance District, the functions of the Council of the County of Dublin under Part I of the Children Act, 1908 (as amended), and under the Children (Amendment) Act, 1957 (No. 28 of 1957).

(3) The Rathdown Board of Assistance are hereby authorised to perform, in respect of the Rathdown Public Assistance District, the functions of the Council of the County of Dublin under Part I of the Children Act, 1908 (as amended), and under the Children (Amendment) Act, 1957 (No. 28 of 1957).

(4) The expenses of a board of assistance in performing functions in accordance with the provisions of this article shall be metin the same way as are their expenses in performing functions in accordance with the provisions of the principal order.

EXPLANATORY NOTE.

Certain functions of health authorities are performed by the Boards of Assistance in the Dublin area in accordance with Orders made by the Minister for Health. The main purpose of this statutory instrument is to amend the terms of these Orders so that they will be in accord with the changes made by he Health and Mental Treatment (Amendment) Act, 1958 and Regulations relating to that Act. Some other minor amendments and extensions of the earlier Orders are also provided for.
