PUBLIC HEALTH (IRELAND) ACT, 1878, (SECTIONS 128, 129 AND 130) COUNTY HEALTH DISTRICTS OF CORK ORDER, 1958.

The Minister for Local Government, on the application of the Council of the County of Cork, in exercise of the powers vested in him by section 1 of the Public Health (Ireland) Act, 1896, hereby declares and orders as follows :—

1. This Order may be cited as the Public Health (Ireland) Act, 1878, (Sections 128, 129 and 130) County Health Districts of Cork Order, 1958.

2. The provisions of sections 128, 129 and 130 of the Public Health (Ireland) Act, 1878, shall be in force within the limits of the County Health Districts of North, South and West Cork on and from the 1st day of November, 1958, and the Council of the County of Cork is hereby invested with all the powers, rights, duties, liabilities, capacities and obligations of an urban district council under the said sections 128, 129 and 130 of the Public Health (Ireland) Act, 1878, to be exercised and attach within the said County Health Districts.

EXPLANATORY NOTE.

The effect of this Order is to bring sections 128, 129 and 130 of the Public Health (Ireland) Act, 1878 into force in the County Health Districts of North, South and West Cork. These sections render liable to penalties a person who establishes or carries on an unauthorised offensive trade, authorise the Council of the County of Cork to make bye-laws with respect to offensive trades and impose a duty on the said Council to institute court proceedings in respect of a nuisance or injury to health caused by an offensive trade.
