OFFENCES AGAINST THE STATE (AMENDMENT) ACT, 1940, (DETENTION) (AMENDMENT) REGULATIONS, 1958.

I, CAOIMHGHÍN Ó BEOLÁIN, Aire Cosanta, a Minister of State, in exercise of the powers conferred on me by section 7 of the Offences Against the State (Amendment) Act, 1940 (No. 2 of 1940), do hereby order and make the following regulations :

1. These Regulations may be cited as the Offences Against the State (Amendment) Act, 1940 , (Detention) (Amendment) Regulations, 1958.

2. In these Regulations " the Principal Regulations " means the Offences Against the State (Amendment) Act, 1940 , (Detention) Regulations, 1957 ( S.I. No. 146 of 1957 ), as amended by the Offences Against the State (Amendment) Act, 1940 , (Detention) (Amendment) Regulations, 1957 ( S.I. No. 154 of 1957 ).

3. Paragraph 13 of the Principal Regulations is hereby amended by the addition to subparagraph (1) of the following :

" (d) food parcels, tobacco and cigarettes, and such other articles as may be approved by the Commandant. "

4. The following paragraph shall be substituted for paragraph 21 of the Principal Regulations :

" Exercises.

21. (1) Subject to subparagraph (2) of this paragraph, internees shall, where practicable, be permitted to associate and to take exercise during the hours of daylight.

(2) The Commandant may, at his discretion, extend or restrict the time permitted for association and taking of exercise under subparagraph (1) of this paragraph. "

5. Paragraph 32 of the Principal Regulations is hereby amended by the deletion of subparagraph (b).

6. The following paragraphs shall be substituted for paragraphs 37 and 38 of the Principal Regulations :

" Expenditure of moneys on behalf of internee.

37. The Commandant may, out of moneys in his custody belonging to an internee or forwarded on his behalf, purchase, at the request of the internee, such commodities and materialsas may be approved by the Commandant, and the amount so expended shall be debited to the account of the internee.

Opening of canteen.

37A. A canteen operated by Bórd Ceaintín an Airm, may be opened daily in a camp and an internee may, in accordance with a token or voucher system, purchase, as against moneys held on his behalf by the Commandant, from such canteen such commodities as may be approved by the Commandant, and the amount so expended shall be debited to the account of the internee.

Establishment of Camp Fund.

37B. (1) Where the Adjutant-General so directs in relation to a camp, there shall be established in that camp a Camp Fund composed of moneys which may become available by way of contributions from Bórd Ceaintín an Airm, from the sale of swill and from any other source.

(2) Expenditure from a Camp Fund shall be for the following purposes :

(a) to pay for loss of, or wilful damage to, State or other public property by internees ;

(b) to purchase equipment and materials required by internees in connection with such hobbies, handicrafts and instruction as are permitted under paragraph 28 of these Regulations ;

(c) to purchase for internees food supplementary to the normal issues, games, books, tobacco and cigarettes.

(3) The proportion of the moneys available to be expended for each of the purposes mentioned in subparagraph (2) of this paragraph shall be at the discretion of the Adjutant-General.

(4) A Camp Fund shall be audited every three months by a Board appointed by the Officer Commanding the Command in which the camp is situated.

Articles made become internee's property

38. Where materials are purchased on behalf of an internee in accordance with paragraph 37 or paragraph 37B of these Regulations, the articles made by him shall become his property."

EXPLANATORY NOTE.

These Regulations effect minor changes in the Principal Regulations ( S.I. No. 146 of 1957 as amended by S.I. No. 154 of 1957 ) which provide for the command and administration of a camp for the internment of civilians.
