S.I. No. 231/1957 - Garda Síochána Pensions Order, 1957.


I, OSCAR TRAYNOR, Minister for Justice, in exercise of the powers conferred on me by section 13 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the sanction of the Minister for Finance and after due compliance with subsection (2) of the said section 13, order as follows :—

1. This Order may be cited as the Garda Síochána Pensions Order, 1957.

2. The Garda Síochána Pensions Orders, 1925 to 1955, and this Order may be cited together as the Garda Síochána Pensions Orders, 1925 to 1957.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In the case of a member of the force who—

(a) is referred to in the portion of Paragraph A of Part I of the First Schedule to the Garda Síochána Pensions Order, 1925 ( S. R. & O. No. 63 of 1925 ), which was added by Article 28 of the Garda Síochána Pensions Order, 1950 ( S.I. No. 154 of 1950 ), and

(b) would, but for that portion of the said Paragraph A, by virtue of the Pensions (Increase) Act, 1956 (No. 44 of 1956), be entitled to an increase in his pension under the Garda Síochána Pensions Orders, 1925 to 1955,

the reference to annual pay in that part of the said Paragraph A shall, with effect from the 1st day of August, 1956, be construed as a reference to the annual pay of a member of the force of equivalent status and service whose approved service was reckoned pursuant to paragraph (9) of Article 9 of the Garda Síochána Pensions Order, 1925 (inserted by Article 25 of the Garda Síochána Pensions Order, 1950) and who retired on the 1st day of November, 1952.

EXPLANATORY NOTE.

This Order modifies the aggregate limit applying where Army Retired Pay and a pension under the Garda Síochána Pensions Orders are payable, so as to permit the grant of an appropriate increase under the Pensions (Increase) Act, 1956 .
