WIRELESS TELEGRAPHY ACT, 1926. WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE) REGULATIONS, 1957.

I, NEIL TERENCE BLANEY, Minister for Posts and Telegraphs, in exercise of the power conferred on me by subsection (1) of section 6 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and, so far as these Regulations refer to fees, with the consent of the Minister for Finance, by this Order make the following Regulations :—

1. This Order and the Regulations hereby made may be cited as the Wireless Telegraphy (Business Radio Licence) Regulations, 1957, and shall come into operation on the 1st day of October, 1957.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Minister for Posts and Telegraphs may, if he so thinks proper, issue a temporary business radio licence (in these Regulations referred to as a licence) to any person but may, at his absolute discretion, refuse to issue such a licence.

4. A licence shall, unless previously revoked and subject to any suspension thereof, continue in force from the date of issue thereof until the expiration of the fifth month after the month in which it was issued, and shall then expire unless renewed.

5. A licence may be renewed once only by the payment, before or within one month after the date on which it would expire if not renewed, of the fee prescribed by these Regulations.

6. A licence which is renewed shall, unless previously revoked and subject to any suspension thereof, continue in force for six months from the date on which it would have expired if not so renewed.

7. A fee shall be payable on the issue and renewal of a licence and such fee shall be calculated on the following basis :

(a) system comprising base and mobile stations only or system comprising mobile stations only : a fixed sum of three pounds plus three pounds for each station,

(b) system comprising base, repeater and mobile stations or mobile and repeater stations : a fixed sum of three pounds plus three pounds for each base station and each mobile station plus twelve pounds in respect of each repeater station,

(c) system comprising two fixed stations only, that is to say, a fixed point-to-point system : a fixed sum of fifteen pounds plus three pounds for each station,

(d) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations : a fixed sum of fifteen pounds plus three pounds for each fixed station plus twelve pounds in respect of each repeater station.

8. The Wireless Telegraphy (Business Radio Licence) Regulations, 1949 ( S.I. No. 320 of 1949 ), as amended, other than Regulations 5, 7 and 8 and paragraph (1) of Regulation 9 thereof, shall apply in relation to a licence.

Explanatory Note.

The Regulations provide for the issue of business radio licences covering periods not exceeding six months at a lower scale of fees than that prescribed in existing Regulations (S.I. Nos. 320 of 1949 and 2 of 1956) which provide for licences on an annual basis.
