AGRICULTURAL WAGES (MINIMUM RATES) (WEEKLY HALF. HOLIDAYS) ORDER, 1953.

The Agricultural Wages Board in exercise of the powers conferred on them by section 17 of the Agricultural Wages Act, 1936 (No. 53 of 1936), and section 11 of the Agricultural Workers (Weekly Half-Holidays) Act, 1952 (No. 26 of 1952), and of every and any other power them in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Agricultural Wages (Minimum Rates) (Weekly Half-Holidays) Order, 1953.

(2) This Order shall come into operation on the commencement of the Act.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

" the Act "means the Agricultural Workers (Weekly Half-Holidays) Act, 1952 (No. 26 of 1952).

4. The minimum rate per hour payable for time worked on a half-holiday under the Act shall be,

(a) in the case of a class of agricultural workers for whom minimum rates of wages are prescribed in an order under the Agricultural Wages Act, 1936 , for the time being in force, the overtime rate mentioned opposite to the mention of such class in the appropriate Schedule to that order ;

(b) in the case of any other agricultural worker, a rate calculated at one-thirtysixth of his earnings (exclusive of his earnings under this paragraph) in respect of the week in which the half-holiday is allowable.

5.—(1) For the purpose of computing the minimum amount under section 8 of the Act, benefits or advantages provided for the worker by his employer shall be reckoned as payment of the minimum amount in lieu of payment in cash to the same extent as they are to be reckoned as payment of wages in accordance with an order under the Agricultural Wages Act, 1936 , for the time being in force.

(2) For the purposes of this Order, the values of benefits or advantages for the time being prescribed for male agricultural workers shall apply to all agricultural workers including holders of permits, and the values prescribed for male workers under 17 years and not under 16 years shall apply to all workers under 16 years.
