PUBLIC ASSISTANCE AUTHORITIES (HEALTH FUNCTIONS) ORDER, 1953.

The Minister for Health, in exercise of the powers conferred on him by sections 45 and 46 of the Health Act, 1953 (No. 26 of 1953), hereby orders as follows :—

1. This Order may be cited as the Public Assistance Authorities (Health Functions) Order, 1953.

2. In this Order, the expression " the Act " means the Health Act, 1953 (No. 26 of 1953).

3. This Order shall come into operation on the 1st day of January, 1954.

4.—(1) The Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin and the Council of the County of Dublin are hereby authorised to act jointly, in respect of the Dublin Public Assistance District, in the performance of their functions under section 23 of the Act and such joint action shall be carried out by the Dublin Board of Assistance.

(2) The Balrothery Board of Assistance are hereby authorised to perform, in respect of the Balrothery Public Assistance District, the functions of the Council of the County of Dublin under section 23 of the Act.

(3) The Rathdown Board of Assistance are hereby authorised to perform, in respect of the Rathdown Public Assistance District, the functions of the Council of the County of Dublin under section 23 of the Act.

(4) The Lord Mayor, Aldermen and Burgesses of Cork and the Council of the County of Cork are hereby authorised to act jointly, in respect of the South Cork Public Assistance District, in the performance of their functions under section 23 of the Act, and such joint action shall be carried out by the Board of Public Assistance for the South Cork Public Assistance District.

(5) The Mayor, Aldermen and Burgesses of Waterford and the Council of the County of Waterford are hereby authorised to act jointly in the performance of their functions under section 23 of the Act and such joint action shall be carried out by the Board of Public Assistance for the Waterford Public Assistance District.

5.—(1) The money required to meet the expenses of a Board of Assistance or a Board of Public Assistance (other than the Balrothery Board of Assistance and the Rathdown Board of Assistance) inperforming functions in accordance with the provisions of this Order shall, at such times as shall be agreed upon between the Board and the health authorities or in default of agreement as may be determined by the Minister, be recouped by the health authorities whose functions under section 23 of the Act are performed by the Board as follows :—

(a) each such health authority shall pay a sum equivalent to the total of the grants under section 23 of the Act paid by the Board to women normally resident in the functional area of that health authority ;

(b) the money to meet any other expenses of the Board (including grants under section 23 of the Act paid to women without a permanent place of abode in any public assistance district) shall be paid by such health authorities in the same proportions as the expenses of the Board are supplied under subsection (1) of section 53 of the Public Assistance Act, 1939 (No. 27 of 1939).

(2) The money required to meet the expenses of the Balrothery Board of Assistance and of the Rathdown Board of Assistance in performing functions in accordance with the provisions of this Order shall be supplied by the Council of the County of Dublin.

6. For the purpose of their performance of functions under section 23 of the Act in accordance with this Order, section 2 of the Health Act, 1947 (No. 28 of 1947), and section 29 of the Act shall apply to a board of assistance and a board of public assistance in the same manner as they apply to a health authority.

7. The Maternity Cash Grants Regulations, 1953 ( S.I. No. 410 of 1953 ), shall apply to a board of assistance and a board of public assistance and, in such application, any reference therein to a health authority shall be construed as a reference to the board.
