RATES AND FARES FOR HIRING HACKNEY CARRIAGES LICENSED UNDER THE DUBLIN CARRIAGE ACTS.

DUBLIN CARRIAGE BYE-LAWS, 1946.

I, MICHAEL J. KINNANE, Commissioner of the Gárda Síochána, in exercise of the powers conferred on me by the Dublin Carriage Act, 1853, as amended or adapted by or under subsequent enactments hereby make the following bye-laws :

PART I. PRELIMINARY.

1 Short title.

1. These bye-laws may be cited as the Dublin Carriage Bye-laws, 1946.

2 Interpretation.

2.—(1) in these bye-laws—

" the Acts " means the Dublin Carriage Act, 1853, as amended by the Dublin Amended Carriage Act, 1854, and the Dublin Amended Carriage Act, 1855 ;

" the Act of 1853 " means the Dublin Carriage Art, 1853 ;

" licensed " means licensed under the Acts ;

" vehicle " means any vehicle being a stage carriage, hackney carriage or cabriolet,

(2) The Interpretation Act, 1937 (No. 38 of 1937), applies to these bye-laws,

3 Lawfull rates and fares for hackney carraiges.

3. The rates and fares which may lawfully be charged for the hire of licensed hackney carriages shall be those appropriate in accordance with the Schedule to these bye-laws,

PART III. CONDUCT AND DUTIES OF DRIVERS AND CONDUCTORS.

4 Rules of Conduct.

4. A person while engaged as driver or conductor of a licensed vehicle, shall comply with the following rules :

(i) he shall be sober, clean and decently dressed,

(ii) he shall obey the reasonable orders of the persons using the vehicle,

(iii) he shall conduct himself in a civil and respectful manner,

(iv) he shall be in constant attendance on the vehicle,

(v) he shall not sit, sleep, lie, or rest within the body or on the roof of the vehicle,

(vi) he shall not prevent or hinder any person from taking the number of the vehicle or the name of the proprietor thereof,

(vii) he shall not remove, deface, cover or obliterate the number of the vehicle or the name of the proprietor thereof,

(viii) he shall not drive the vehicle, or permit it to be driven at an unreasonable speed or in an unreasonable manner,

(ix) he shall not allow any person (other than the driver) on the driving seat or driving platform of the vehicle except with the consent of the person hiring the vehicle,

(x) he shall not take up extra passengers except with the consent of the person first hiring the vehicle,

(xi) immediately after setting down a passenger he shall examine the vehicle to ascertain if any property of such passenger has been left therein,

(xii) he shall not, without reasonable excuse, fail to perform any contract of hiring,

(xiii) he shall take care of the vehicles, horses, harness, and all other property whatsoever delivered to his care,

5 Badges to be worn.

5. A person shall, while engaged as driver or conductor of a licensed vehicle, wear, in a conspicuous manner, the badge required by law to be worn by all such drivers and conductors,

6 Feeding of horses in public thoroughfare.

6. The drivers of licensed hackney carriages and cabriolets shall not—

(a) feed their horses in any public thoroughfare except from nose-bags ;

(b) remove the winkers from their horses in any public thoroughfare for the purpose of feeding them.

7 Drivers to produce bye-laws on demand.

7. A driver of a licensed hackney carriage or cabriolet shall have with him when employed as such driver a copy of these bye-laws and shall on demand produce it to the hirer of the vehicle or any member of the Gárda Síochána.

8 Driver to inform hirer of fare.

8. When a person proposes to hire a licensed hackney carriage or cabriolet, the driver thereof shall, when called to hire, on the request of the hirer, inform the hirer of the amount of the fare chargeable for the proposed journey.

PART IV. DUBLIN PLATE.

9 Fixing of Dublin Plate to vehicles.

9.—(1) The Dublin Plate shall be firmly fixed to every licensed vehicle as follows :

(i) on stage carriages, at the left side of the door

(ii) on cabriolets, on the outside of the shaft over the fore-carriage at the leading side ;

(iii) on hackney carriages, on the outside of the shaft at the leading side, within one foot of the fore-bar.

(2) Dublin Plates fixed to vehicles in accordance with paragraph (1) of this bye-law shall be kept clean so as to admit of the several figures, letters, and devices thereon being identified during the time such vehicles are in use within the meaning of their respective licences.

10 Display of Dublin Plate number on vehicles.

10. The proprietor of a licensed vehicle shall at all times cause to be displayed thereon the number of the Dublin Plate issued in respect of the vehicle, and the said number shall be painted, in plain legible figures and in a colour different from the colour on which the figures are painted, as follows :

(a) on stage carriages, in figures not less than one inch in height ;

(b) on hackney carriages, in figures not less than two inches in height and half an inch in breadth, such figures, in case of hackney carriages known as outside cars, on the outside in the middle of such car, and in case of hackney carriages known as inside or covered cars, on the outside on the back in the middle of the door panel ;

(c) on cabriolets, on the outside on each door in the middle beneath the windows and on the outside in the middle on the upper portion of the back.

11 Restriction on transfer of Dublin Plate.

11. The proprietor of a licensed vehicle shall not transfer the Dublin Plate, nor shall he permit such transfer, from that vehicle to any other vehicle unless he first produces such other vehicle at the carriage office for inspection, or such other vehicle has been inspected and passed within a period of six months immediately before such transfer.

12 Application for new Dublin Plate.

12. Where an application is made, under section 18 of the Act of 1853, for the delivery to the applicant of a new Dublin Plate to replace a Dublin Plate which is stated by him to have been lost or mislaid the proper officer may, in his discretion, require the applicant to make a statutory declaration affirming the truth of the statement and that, to the best of his knowledge and belief, the said Dublin Plate already delivered has not been sold, exchanged, pledged, bestowed, lent or otherwise made away with.

PART V. CONDITION AND UPKEEP OF VEHICLES.

13 Lighting of stage carraiges.

13. The proprietor of a licensed stage carriage shall cause it to be kept adequately lighted while conveying passengers within the Dublin Metropolitan Area after sunset.

14 Vehicles and equipment to be kept clean and painted.

14.—(1) The proprietor of a licensed vehicle shall cause the vehicle and the harness, braces, tackling, accoutrements, machinery, fittings and appliances thereof to be kept clean and in good repair.

(2) The proprietor of a licensed vehicle shall cause the vehicle to be properly painted or varnished and shall keep such paint or varnish bright and in good condition.

15 Bell to be provided.

15. The proprietor of every licensed stage carriage shall provide a bell to facilitate communication with the driver of the carriage.

16 Horses to be suitable.

16. The proprietor of a licensed vehicle shall not use a horse to draw the vehicle unless the horse is suitable for such use.

17 Hackney carriages and cabriolets to be kept free from hay, oats, etc.

17. The driver of a licensed hackney carriage or cabriolet shall, while employed as such driver, keep the inside of such vehicle free from hay, oats or any offensive matter or thing.

18 Notice as to permitted number of passengers

18.—(1) Where a licensed stage carriage is designed to carry passengers in upper and lower compartments, the proprietor thereof shall maintain thereon a notice (which shall be painted on some conspicuous part of the inside of each compartment) of the maximum number of passengers permitted to be carried in each such compartment according to the licence granted in respect of such carriage.

(2) The proprietor of a licensed stage carriage shall not permit to be carried therein passengers in excess of the maximum number permitted by the licence granted in respect of such carriage.

19 Display of name and address of proprietor.

19. The proprietor of a licensed vehicle shall at all times cause to be displayed thereon, in plain legible letters and in a conspicuous colour, the name and address of the proprietor of the vehicle, as follows :

(a) on stage carriages, on the sides ;

(b) on hackney carriages and cabriolets, on the outside of the near shaft near the connecting bar.

20 Display of fares list.

20. The proprietor of a licensed stage carriage shall maintain, in a conspicuous place in such carriage, a legible scale of fares chargeable to passengers therein.

21 Name, address and badge number of driver to be supplied on demand.

21. The proprietor of a licensed vehicle shall, on the demand of the hirer of the vehicle, or of a member of the Gárda Síochána, forthwith furnish the name, address and badge number of the driver of the vehicle in respect of whom the demand is made.

PART VI. CARRIAGE STANDS.

22 Stands.

22. The drivers of licensed hackney carriages and cabriolets shall wait to be hired at one of the stations for the time being appointed under section 49 of the Act of 1853, and at no other place.

23 Head of the Stand.

23.—(1) Where drivers of hackney carriages or cabriolets are waiting to be hired in accordance with the provisions of bye-law 22 hereof, the driver of the vehicle at the head of the stand only shall answer a general call to hire.

(2) Nothing in paragraph (1) of this bye-law shall prevent a hirer from hiring a vehicle other than the vehicle at the head of the stand.

(3) In this bye-law the expression " the head of the stand " shall mean the end to which vehicles are required to face by any order, direction, or bye-law for the time being in force under section 49 of the Act of 1853.

PART VII. PENALTIES.

24 Penalties.

24. A person who contravenes, whether by act or omission, any provision of these bye-laws for which no penalty is provided by the Acts shall be guilty of an offence and shall, on summary conviction thereof, be liable to a fine not exceeding forty shillings.

PART VIII. REPEALS.

25 Repeal of existing Bye-laws.

25. All Rules, Orders and Bye-laws made under section 50 of the Dublin Carriage Act, 1853, and in force immediately before the making of these bye-laws, are hereby repealed.

SCHEDULE.

RATES AND FARES FOR HIRING HACKNEY CARRIAGES LICENSED UNDER THE DUBLIN CARRIAGE ACTS.

1. Where in a particular case more than one method of calculating the fare is applicable, the hirer shall have the option, at the end of the engagement, of selecting the method by which the fare is to be calculated.

2. Fares calculated by set-down shall be in accordance with the following scale :

Where the driver is called upon by the hirer to stop in the course of the drive, and the driver informs the hirer that if he does so an additional charge of sixpence will be made for the stop, there may be made for the stop an additional charge of

3. Fares calculated by distance shall be in accordance with the following scale :

For any distance not exceeding one mile, a fare of

Where the driver is required by the hirer to wait for a period exceeding ten minutes, an extra charge for the whole period of waiting at the rate, for every fifteen minutes commenced, of

4. Fares calculated by time shall be in accordance with the following scale :

For any time not exceeding twenty minutes, a fare of

5. A driver shall proceed if required to the house of the hirer from a Stand without charge if the distance thereto is not greater than one mile, and if the distance exceeds one mile, or if the driver is not further employed, he shall be paid one shilling.

6.—(1) Luggage shall be charged for in accordance with the following scale :

For each bicycle or perambulator (to be carried at the option of the driver)

For each article of any other description (to be carried at the option of the driver)

(2) A charge under this paragraph for luggage shall cover the whole of the period of hiring, irrespective of the time or distance involved.

(3) In this paragraph, the word " luggage " does not include a small parcel, book, umbrella, or other article carried in the hand, and no charge shall be made therefor.

7. The hirer may bring an extra passenger or extra passengers with him without extra charge, but the driver shall not be required to bring a greater number of passengers than the number for which there is seating accommodation, allowing a space of sixteen inches for each passenger over twelve years of age and a space of eight inches for each passenger of twelve years of age or under.

APPENDIX.

BOUNDARY FOR SET-DOWN FARES.

From the Royal Canal Bridge at the North Wall, by the western side of the said Canal to Binn's Bridge, Drumcondra, thence by Lower Dorset Street to the North Circular Road, thence by the said North Circular Road, Infirmary Road, and Parkgate Street to the entrance to the Phœnix Park in Parkgate Street, thence in a direct line across the River Liffey and railway line of Córas Iompair Éireann to the junction of Military Road with St. John's Road, thence by the said Military Road, Irwin Street, Bowbridge and Cromwell's Quarters to Mountbrown, thence in a direct line through Saint Kevin's Institution and across the Grand Canal to the northern end of Reuben Street, thence by the said Reuben Street, Dolphin's Barn Street, South Circular Road (Dolphin's Barn) to Donore Avenue, thence by Donore Avenue to Parnell Bridge over the Grand Canal, thence along the north side of the Grand Canal to Grand Canal Street, and thence by the Grand Canal Quay and Forbes Street to the Junction of the said Forbes Street with the Liffey Wall at Sir John Rogerson's Quay.

All premises situated on the above boundary line, that is to say, on the street, road or lane forming such line, shall be considered as within such boundary no matter on which side of the street, road or lane they may be situated.
