STATUTORY RULES AND ORDERS. 1945. No. 82.

PUBLIC ASSISTANCE (STATE GRANTS) (ADAPTATION) ORDER, 1945.

WHEREAS by sub-section (1) of section 89 of the Public Assistance Act, 1939 (hereinafter referred to as "the Act of 1939") the Minister for Local Government and Public Health is empowered by order to make such adaptations of any enactment in force at the commencement of the said Act and relating to any matter affected by the said Act as appear to him to be necessary or expedient for carrying the said Act into effect or for enabling the said Act to have full force and effect :

AND WHEREAS each of the enactments in which adaptations and modifications are made by this Order were in force at the commencement of the Act of 1939 and relate to matters or things dealt with or affected by the Act of 1939 :

AND WHEREAS it appears to the Minister for Local Government and Public Health expedient for enabling the Act of 1939 to have full force and effect that there should be made in each of the said enactments the adaptations or modifications hereinafter appearing :

NOW THEREFORE, the Minister for Local Government and Public Health in exercise of the power conferred on him by the said sub-section (1) of section 89 of the Act of 1939 hereby orders as follows, that is to say :—

1. In paragraph (h) of sub-section (1) of section 3 of the Probate Duties (Ireland) Act, 1888, as amended by the Finance Act, 1894,

(a) the words " public assistance authorities of the public assistance districts " shall be substituted for the words " guardians of the Unions in Ireland ", and

(b) the words " guardians of the unions situate within each public assistance district " shall be substituted for the words " guardians of each union ".

2. In sub-section (2) of the said section 3 of the Probate Duties (Ireland) Act, 1888, as amended by the Finance Act, 1894, the words " a public assistance authority " shall be substituted for the words " the guardians of a union ".

3. For paragraph (a) of sub-section (2) of Section 58 of the Local Government (Ireland) Act, 1898, the following paragraph shall be substituted, that is to say :—

(a) to each County Council on behalf of the public assistance authorities the following amounts towards the salaries approved by the Minister for Local Government and Public Health of the following officers, namely,

(i) one half of the said salaries of the medical officers of the district institutions and dispensaries; and

(ii) one half of the said salary of one trained nurse in a district institution in each public assistance district ; and

(iii) the whole of the said salaries of schoolmasters and schoolmistresses in the district institutions ; and also one half of the cost of such medicines and medical and surgical appliances as are provided in accordance with the prescribed conditions :

4. In sub-section (1) of section 5 of the Local Government (Ireland) Act, 1902 :—

(a) the words " lawfully paid by a public assistance authority " shall be substituted for the words " paid with the sanction of the Local Government Board by the guardians of a union " ; and

(b) the words " district institution " shall be substituted for the word " workhouse "; and

(c) the words " under the authority of any order or regulation made under Part II of the Local Government Act, 1941 " shall be substituted for the words " under the authority of any general regulation of the Local Government Board made under the Poor Relief (Ireland) Acts, 1838 to 1900 ".

5. In sub-section (1) of section 6 of the Local Government (Ireland) Act, 1902—

(a) the words " public assistance authority of any public assistance district " shall be substituted for the words " guardians of any union ", and

(b) the words " the guardians of all the unions situate within that public assistance district " shall be substituted for the words " those guardians ".

6. This Order may be cited as the Public Assistance (State Grants) (Adaptation) Order, 1945.
