S.I. No. 303/1943 - Gárda Síochána (Promotion) Regulations, 1943.


The Minister for Justice, with the approval of the Government, in exercise of the powers conferred on him by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power him in this behalf enabling, hereby makes the following Regulations :

1. (1) These Regulations may be cited as the Gárda Síochána (Promotion) Regulations, 1943.

(2) The Gárda Síochána (Promotion) Regulations, 1925, the Gárda Síochána (Promotion) Regulations, 1929, the Gárda Síochána (Promotion) Regulations, 1936 ( S. R. & O. No. 187 of 1936 ), the Gárda Síochána (Promotion) (No. 2) Regulations, 1936 ( S. R. & O. No. 242 of 1936 ), the Gárda Síochána (Promotion) Regulations, 1942 ( S. R. & O. No. 339 of 1942 ), and these Regulations may be cited together as the Gárda Síochána (Promotion) Regulations, 1925 to 1943.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. Regulation 9 of the Gárda Síochána (Promotion) Regulations, 1925, is hereby amended by the addition thereto of the following paragraph :

" Notwithstanding the foregoing provisions of this regulation, where the Commissioner is satisfied that a Sergeant who has not passed, and is not exempted under these regulations from passing, the Class I Promotion examinations has given consistently meritorious service in the Detective Branch and has shown special zeal and ability in the performance of his duties, the Commissioner may, with the approval of the Minister for Justice, promote him to the rank of Inspector, but, before so promoting him, the Commissioner shall appoint a board of members of the Gárda Síochána not below the rank of Chief Superintendent to inquire into the record of his serviceand efficiency and to interview him as to his general suitability for promotion and shall consider the report of such board on such inquiry and interview."
