STATUTORY RULES AND ORDERS. 1943. No. 301.

DISTRICT COURT (AREAS) ORDER, 1943.

WHEREAS it is enacted by subsection (3) of section 47 of the Court Officers Act, 1926 (No. 27 of 1926), that it shall be lawful for the Minister for Justice from time to time as he shall consider expedient, to do (amongst other things) either or both of the following things, that is to say, (a) vary or abolish any district court area created by him under subsection (1) of the said section, or (b) create any new such district court area :

AND WHEREAS by the District Court (New Areas) Order, 1927 ( S. R. & O. No. 103 of 1927 ), the Minister for Justice abolished the several district court areas theretofore created by him under the said subsection (1) of section 47 of the Court Officers Act, 1926 , and created new district court areas for the purposes of the said subsection :

NOW, I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by subsection (3) of section 47 of the Court Officers Act, 1926 (No. 27 of 1926), and of every and any other power me in this behalf enabling, hereby order as follows, that is to say :—

1. This Order may be cited as the District Court (Areas) Order, 1943.

2. This Order shall come into operation on the 1st day of November, 1943.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order—

the expression " the Principal Order " means the District Court (New Areas) Order, 1927 ( S. R. & O. No. 103 of 1927 ).

5. So much of the Principal Order as provides—

(a) that the district electoral division of Convoy shall, for the purpose of civil proceedings in the District Court, be comprised and included in the district court area of Stranorlar, in the County of Donegal, and

(b) that the following district electoral divisions, that is to say, Feddyglass, Figart, Kincraigy, Raphoe, St. Johnstown, and Treantaghmucklagh, shall be comprised and included, for the purpose of such civil proceedings as aforesaid, in the district court area of Lifford, in the County of Donegal, and

(c) that the following district electoral divisions, that is to say, Belhavel, Cloonlogher, Dromahaire, Garvagh, Kilanummery, and Sramore, shall be comprised and included, for the purpose of such civil proceedings as aforesaid, in the district court area of Manorhamilton, in the County of Leitrim,

is hereby revoked.

6. (1) For the purpose of civil proceedings in the District Court, the areas specified in the second column of the Schedule hereto shall be district court areas and shall, accordingly, be deemed to be included in the district court areas set forth in Part I of the Schedule to the Principal Order.

(2) Each of the district court areas created by subparagraph (1) of this paragraph shall comprise and consist of the several district electoral divisions specified in the third column of the Schedule hereto opposite the mention of such district court area in the second column of the said Schedule.
