STATUTORY RULES AND ORDERS. 1943. No. 147.

DUBLIN DISTRICT MILK BOARD (MINIMUM PRICES FOR MILK) ORDER, 1943.

WHEREAS a determination of the Dublin District Milk Board under section 42 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), was communicated to the Minister for Agriculture and has been considered by him :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, inexercise of the powers conferred on me by clause (i) of paragraph(b) of sub-section (1) of section 43 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of every and any other power me in this behalf enabling, do hereby order as follows:—

1. This Order may be cited is the Dublin District Milk Board(Minimum Prices for Milk) Order, 1943, and shall come intooperation on the 1st day of May, 1943.

2. In this Order—

the expression "registered producers" means persons registeredin the register of producers kept by the Dublin District Milk Board;

the expression "registered retailers" means persons registeredin the register of retailers kept by the Dublin District Milk Board;

the expression "registered wholesalers" means persons registered in the register of wholesalers kept by the DublinDistrict Milk Board ;

the expression "collecting place" means a place other than the producer's registered premises at which milk is delivered by mutual agreement between the producer and the purchaser.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies tothis Order.

4. The Dublin District Milk Board (Minimum Prices for Milk)Order, 1942 (No. 131 of 1942), is hereby revoked.

5. The minimum prices to be paid to registered producers formilk sold by them to registered retailers shall be at the followingrates :—

(1) where the milk is delivered during he months of May to Julyinclusive

(a) if the milk is delivered at registered premises of the purchaser, one shilling and two pencehalfpenny per gallon ;

(b) if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer at the railway station nearest tosuch retailer's registered premises, one shilling and two pencefarthing per gallon ;

(c) if the milk is delivered at the premises of the producer or at the collecting place,

(i) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises does not exceed ten miles,one shilling and one penny halfpenny per gallon ;

(ii) where the distance by public road between the producer'sregistered or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and one penny farthing per gallon;

(iii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, one shilling and one penny per gallon;

(iv) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and three farthings pergallon ;

(v) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds forty miles, oneshilling and a halfpenny per gallon ;

(2) where the milk is delivered during the months of August and September—

(a) if the milk is delivered at registered premises of the purchaser, one shilling and seven pence halfpenny per gallon ;

(b) if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, one shilling and sevenpence farthing per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises does not exceed ten miles,one shilling and six pence halfpenny per gallon ;

(ii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one and six pence farthing per gallon;

(iii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises, exceeds twenty miles, but does not exceed thirty miles, one shilling and six pence per gallon;

(iv) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and five pence threefarthings per gallon ;

(v) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds forty miles, oneshilling and five pence halfpenny per gallon ;

(3) where the milk is delivered during the months of October to April inclusive—

(a) if the milk is delivered at registered premises of the purchaser,two shillings and one penny halfpenny per gallon ;

(b) if the milk is delivered, in the case of a registered retailer carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered retailer, at the railway station nearest to such retailer's registered premises, two shillings and one pennyfarthing per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producers'registered premises, or the collecting place, as the case may be,and the purchaser's registered premises does not exceed ten miles,two shillings and a halfpenny per gallon ;

(ii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, two shillings and a farthing per gallon;

(iii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, two shillings per gallon ;

(iv) where the distance by public road between the producer'sregistered premises, or the collecting place, the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and eleven pence threefarthings per gallon ;

(v) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds forty miles, oneshilling and eleven pence halfpenny per gallon.

6. The minimum prices to be paid to registered producers formilk sold by them to registered wholesalers shall be at the following rates :—

(1) where the milk is delivered during the months of May toJuly inclusive—

(a) if the milk is delivered at registered premises of the purchaser one shilling and one penny pergallon ;

(b) if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, one shilling and threefarthings per gallon ;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer'sregistered premises or the collecting place, as the case may be,and the purchaser's registered premises does not exceed ten miles,one shilling per gallon ;

(ii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, eleven pence three farthings per gallon;

(iii) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, eleven pence halfpenny per gallon;

(iv) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be,and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, eleven pence farthing per gallon;

(v) where the distance by public road between the producer'sregistered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, elevenpence per gallon ;

(2) where the milk is delivered during the months of August and September—

(a) if the milk is delivered at registered premises of the purchaser, one shilling and six penceper gallon ;

(b) if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin; or, in the case of any other registered wholesaler, at the railway stationnearest to such wholesaler's registered premises, one shilling and five pence three farthings per gallon;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and five pence per gallon;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and four pence three farthings per gallon;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, one shilling and four pence halfpenny per gallon;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and four pence farthing per gallon;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and four pence per gallon;

(3) where the milk is delivered during the months of October to April inclusive—

(a) if the milk is delivered at registered premises of the purchaser, two shillings per gallon;

(b) if the milk is delivered, in the case of a registered wholesaler carrying on business in the City of Dublin, at a railway station in the City of Dublin, or, in the case of any other registered wholesaler, at the railway station nearest to such wholesaler's registered premises, one shilling and eleven pence three farthings per gallon;

(c) if the milk is delivered at the registered premises of the producer or at the collecting place,

(i) where the distance by public road between the producer's registered premises, or the collecting place, is the case may be, and the purchaser's registered premises does not exceed ten miles, one shilling and eleven pence per gallon;

(ii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds ten miles, but does not exceed twenty miles, one shilling and ten pence three farthings per gallon;

(iii) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds twenty miles, but does not exceed thirty miles, one shilling and ten pence halfpenny per gallon;

(iv) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds thirty miles, but does not exceed forty miles, one shilling and ten pence farthing per gallon;

(v) where the distance by public road between the producer's registered premises, or the collecting place, as the case may be, and the purchaser's registered premises exceeds forty miles, one shilling and ten pence per gallon.
