LOCAL OFFICERS (REMOVAL BY LOCAL AUTHORITY) REGULATIONS, 1943.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

The Minister for Local Government and Public Health in exercise of the power conferred on him by sections 8 and 26 of the Local Government Act, 1941 , by this his order makes the following regulations, that is to say:—

1. These regulations may be cited as the Local Officers (Removal by Local Authority) Regulations, 1943.

2. In these regulations the expression " the Minister " means the Minister for Local Government and Public Health.

3. Subject to compliance with Article 4 of these regulations a local authority shall be empowered to remove from office with the consent of the Minister the holder of any office in relation to which the Minister is the appropriate Minister.

4. Before applying to the Minister for his consent to the removal from office under these regulations of the holder of an office a local authority shall give to such holder written notice stating—

(a) the intention of the local authority so to apply, and

(b) the reasons for such application, and

(c) that the Minister will consider any representations in relation to such removal which such holder may send to the Minister before the expiration of seven days after the giving of such notice.

5. An application by a local authority to the Minister for his consent to the removal from office under these regulations of the holder of an office shall state the reasons for such application.
