STATUTORY RULES AND ORDERS. 1943. No. 1.

CIVIL SERVICE (EMERGENCY BONUS) REGULATIONS, 1943.

WHEREAS it is enacted by sub-section (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), as adapted in consequence of the enactment of the Constitution, that the Minister for Finance may from time to time make regulations for controlling the Civil Service of the State and providing for the classification, remuneration, and other conditions and terms of service of all persons employed therein, whether permanently or temporarily :

AND WHEREAS it is enacted by sub-section (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), that there shall be paid to all officers and servants appointed by any Minister such salaries and remunerations as the Minister for Finance may from time to time determine :

NOW, I, SEÁN T. Ó CEALLAIGH, Minister for Finance, in exercise of the powers conferred on me by sub-section (1) of section 9 of the Civil Service Regulation Act, 1924 (No. 5 of 1924), and of the powers conferred on me by sub-section (3) of section 2 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924), and of every and any other power me in this behalf enabling, hereby make the following regulations :—

1.—(1) These Regulations may be cited as the Civil Service (Emergency Bonus) Regulations, 1943.

(2) The Civil Service (Stabilisation of Bonus) Regulations, 1940 and 1942, and these Regulations may be cited together as the Civil Service (Stabilisation of Bonus) Regulations, 1940 to 1943.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

the expression " the Principal Regulations " means the Civil Service (Stabilisation of Bonus) Regulations, 1940 ( S. R. & O. No. 177 of 1940 ) ;

the expression " the Amending Regulations " means the Civil Service (Stabilisation of Bonus) (Amendment) Regulations, 1942 ( S. R. & O. No. 258 of 1942 ) ;

the expression " basic salary " and the words " whole-time " and " part-time " have the same meanings as they respectively have in the Amending Regulations ;

the expressions " Civil Service " and " index number " have the same meanings as they respectively have in paragraph 4 of the Principal Regulations.

4.—(1) These Regulations apply to every person to whom the Principal Regulations for the time being apply.

(2) In the application of these Regulations to a person who is, at the date of these Regulations, a person to whom the Principal Regulations apply, the word " remuneration " means remuneration payable in respect of a period beginning on or after whichever of the following dates is the later, that is to say, the 1st day of January, 1943, or the date on which the Principal Regulations began to apply to him.

(3) Paragraphs 5 and 6 of the Amending Regulations shall apply and have effect in relation to these Regulations in like manner as they apply and have effect in relation to the Amending Regulations.

5. Save as is otherwise provided by these Regulations, the Amending Regulations shall not apply to the remuneration of any person who is for the time being a person mentioned in the second column of the First Schedule hereto at any particular reference number and, in lieu thereof, the remuneration of such person shall be increased by the amount of the emergency bonus stated in the third column of the said First Schedule at the said reference number, but subject to the limitation (if any) stated in the fourth column of the said First Schedule at the said reference number.

6. Save as is otherwise provided by these Regulations, the Amending Regulations shall not apply to the remuneration of any person who is for the time being a person mentioned in the second column of the Second Schedule hereto at any particular reference number and, in lieu thereof and notwithstanding anything contained in paragraph 4 of the Principal Regulations, the remuneration of such person shall, as respects so much of his basic salary as is specified in the third column of the said Second Schedule at the said reference number, be calculated by reference to the index number which exceeds by the number of points stated in the fourth column of the said Second Schedule at the said reference number the index number or numbers specified in the said paragraph 4 in respect of such person, but subject to the limitation stated in the fifth column of the said Second Schedule at the said reference number.

7. Where, in the case of a person who is for the time being a person mentioned in the second column of either of the Scheduleshereto, the provisions (applicable to him) of the Amending Regulations would be more favourable to him than the provisions (applicable to him) of these Regulations, the said provisions of the Amending Regulations shall, notwithstanding anything contained in these Regulations, apply to him as if these Regulations had not been made.

The total remuneration (i.e. basic salary, cost-of-living bonus thereon, and emergency bonus) shall not exceed five pounds a week.

A part-time person (whether male or female) who is unmarried and whose basic salary does not exceed three pounds a week.

Three shillings a week.

The total remuneration (i.e. basic salary cost-of-living bonus thereon, and emergency bonus) shall not exceed five pounds a week.

A female person who is a cleaner or a charwoman and is either married or a widow and whose basic salary does not exceed thirteen shillings a week.

Five shillings a week.

A female person who is a cleaner or a charwoman and is unmarried and whose basic salary does not exceed thirteen shillings a week.

Three shillings a week.

An unestablished person (whether male or female) who is unmarried and has not attained the age of twenty-one years.

Two shillings and sixpence a week.
