OFFENCES AGAINST THE STATE ACT, 1939 (MILITARY CUSTODY) (AMENDMENT) (No. 3) REGULATIONS, 1940.

I, OSCAR TRAYNOR, Minister for Defence, in exercise of the powers conferred on me by subsection (4) of section 50 of the Offences against the State Act, 1939 (No. 13 of 1939), and of every and any other power me in this behalf enabling, do hereby make the following regulations, that is to say:—

1.—(1) These Regulations may be cited as the Offences against the State Act, 1939 (Military Custody) (Amendment) (No. 3) Regulations, 1940.

(2) These Regulations shall be included amongst the Regulations which may be cited together as the Offences against the State Act, 1939 (Military Custody) Regulations, 1939 and 1940.

2. In this Order the expression " the Principal Regulations " means the Offences against the State Act, 1939 (Military Custody) Regulations, 1939 (Statutory Rules and Orders, No. 288 of 1939).

3. Paragraph 21 of the Principal Regulations shall not apply in the case of any convicted prisoner who refuses, to such extent as in the opinion of the Medical Officer may endanger the prisoner's health, to partake of food or drink or to wear or use any clothing or bedding provided or available under the Principal Regulations.

4. Paragraph 34 of the Principal Regulations is hereby amended by the insertion in sub-paragraph (d) thereof of the figures " 21 " after the word " paragraphs."
