AN ACT TO ENABLE THE GOVERNMENT TO EXTEND BY ORDER THE TERMS OF OFFICE OF MEMBERS OF THE GOVERNING BODIES OF UNIVERSITY COLLEGE, DUBLIN, UNIVERSITY COLLEGE, CORK, AND UNIVERSITY COLLEGE, GALWAY. [30th October, 1940.]

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:—

Definitions.

1.—In this Act—

the expression “college to which this Act applies” means any of the following colleges, that is to say, University College, Dublin, University College, Cork, and University College, Galway;

the expression “term of office” includes a term of office as extended by virtue of one or more orders made under this Act.

Extension of term of office.

2.—(1) The Government may by order declare that the term of office of the members in office on the date of such order of the Governing Body of any college to which this Act applies shall be extended until a specified date not later than twelve months after the date on which such term of office would, but for such order, expire, and thereupon, notwithstanding anything contained in any enactment (including any charter or statute of such college), the term of office of such members shall be extended until the date so specified.

(2) No order shall be made under this section save on the application of the governing body to whose members such order relates.

(3) Where, before the date of an order made under this section in relation to the members of the Governing Body of a college to which this Act applies, there has not been taken any step prescribed by the statutes of such college in relation to the nomination, appointment and election of members required, but for such order, to take place, it shall be deemed to have been proper not to take such step.

Laying of orders before the Oireachtas.

3.—Every order made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such order is passed by either such House within the next subsequent twenty-one days on which such House has sat after such order is laid before it, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.

Short title.

4.—This Act may be cited as the University Colleges Act, 1940.
