CREAMERY BUTTER (BOUNTY) (AMENDING) (No. 3) ORDER, 1939.

WHEREAS it is enacted by sub-section (1) of Section 34 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), hereinafter referred to as the Principal Act, that the Minister for Agriculture may from time to time by Order make regulations prescribing the rates of bounty under Part VII of the Principal Act on creamery butter, and may at any time amend any such Order.

AND WHEREAS it is enacted by Section 11 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938 (No. 30 of 1938) that whenever the Minister for Agriculture makes an Order (in the said referred to as an amending Order) under sub-section (1) of Section 34 of the Principal Act amending an Order prescribing rates of bounty, the said Minister may by the amending Order prescribe a date earlier than the date of the making thereof as the date on which the amended rates of bounty are to come into force :

AND WHEREAS the Creamery Butter (Bounty) Order, 1939 (Statutory Rules and Orders No. 117 of 1939) was made under sub-section (1) of Section 34 of the Principal Act on the 31st day of March, 1939 :

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of sub-section (1) of Section 34 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935) and Section 11 of the Dairy Produce (Price Stabilisation) (Amendment) Act, 1938 (No. 30 of 1938) and of every and any other power me in this behalf enabling, do by this Order make the following Regulations :—

1. This Order may be cited as the Creamery Butter (Bounty) (Amending) (No. 3) Order, 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

3. In this Order the expression " the Principal Order " means the Creamery Butter (Bounty) Order, 1939 (No. 117 of 1939).

4.—(1) So much of Article 4 of the Principal Order as fixes the rate of bounty on creamery butter to which this Article applies shall cease to have effect in relation to any such butter exported on or after the 1st day of June, 1939, and before the 1st day of September,1939, and in lieu thereof the rate of bounty on such butter shall be seventeen shillings and sixpence the hundredweight.

(2) This Article applies to creamery butter which is approved butter within the meaning of the rules relating to the marketing of butter made on the 16th day of April, 1937, and approved by the Minister for Agriculture under Section 49 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935).

5. The several rates of bounty fixed by Article 4 of the Principal Order shall cease to apply to any creamery butter of any class specified in the said Article exported on or after the 1st day of September, 1939, and in lieu thereof the rate of bounty on creamery butter of any such class exported on or after the 1st day of September, 1939, shall be one penny the hundredweight.
