STATUTORY RULES AND ORDERS. 1939. No. 129.

DAIRY PRODUCE ACT, 1924 (REGULATIONS UNDER PART III) (AMENDMENT) ORDER, 1939.

The Minister for Agriculture, in exercise of the powers conferred on him by the Dairy Produce Act, 1924 (No. 58 of 1924), and of every and any other power him in this behalf enabling, hereby by this Order makes the following regulations, that is to say :—

1.—(1) This Order may be cited as the Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) Order, 1939.

(2) The Dairy Produce Act, 1924 (Regulations under Part III) Orders 1925 to 1936, and this Order may be cited together as the Dairy Produce Act, 1924 (Regulations under Part III) Orders 1925 to 1939.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order the expression " the Principal Order " means the Dairy Produce Act, 1924 (Regulations under Part III) Order No. 1, 1925 (Statutory Rules and Orders No. 51 of 1925).

4. Regulation 4 of the Principal Order is hereby amended by the deletion of sub-section (5) thereof and the substitution therefor of the following new sub-section :—

" (5) All butter packed in rolls on registered premises shall be cleanly moulded in such rolls, and each such roll shall be wrapped in parchment paper of the quality set out in the second Schedule hereto, and the rolls and cartons used (if any) shall be packed in non-odorous and waterproof fibreboard packages or in wooden packages made of timber which is well seasoned, clean, dry, free from bark, wane and feather and large knots, and so constructed as to prevent any movement of the contents in transit."

5. Regulation 5 of the Principal Order is hereby amended in the following respects—

(a) by the deletion of paragraph (c) of sub-section (1) of the said Regulation and the substitution therefor of the following new paragraph—

"(c) such of the following particulars as are applicable:—

(i) the words " Éire Irish Creamery Butter " in the case of butter packed on premises registered in the register of creameries or comprised in a subsisting licence granted under Section 42 of the Act ;

(ii) the words " Éire Irish Butter " in the case of butter packed on premises registered in the register of manufacturing exporters and not comprised in a subsisting licence granted under Section 42 of the Act ;

(iii) the words " Éire Irish Butter " with the word " Factory " placed immediately in front of the identification mark in the case of butter packed on premises registered in the register of butter factories ;

(iv) the words " Éire Irish Farm Butter " in the case of butter obtained otherwise than from premises registered under the Act exported from premises registered in the register of non-manufacturing exporters."

(b) by the deletion in sub-section (3) and paragraph (b) of sub-section (5) of the said Regulation of the words " bricks or " wherever they occur ;

(c) by the deletion of paragraph (a) of sub-section (5) of the said Regulation and the substitution therefor of the following new paragraph—

"(a) The marks prescribed for packages shall, unless otherwise provided, be made in capital block letters and figures of the following dimensions, that is to say :—

(i) in the case of 56 lb. and 28 lb. boxes—three-quarter inch high ;

(ii) in the case of 14 lb. boxes—one-half inch high ;

(iii) in the case of casks, kegs and firkins—one-half inch high ;

(iv) in the case of boxes used for packing rolls—not less than three-quarter inch high, and shall be plainly inscribed thereon by printing or burning in a dark-brown colour, save that in the case of packages containing butter described as " Éire Irish Farm Butter," the marks may be inscribed by stencilling."

6. The Principal Order shall be construed and have effect as if there were inserted therein after Regulation 5, the following additional Regulation—

" 5A The vegetable parchment paper and the cartons (if any) used for wrapping rolls on registered premises shall be marked on the outside with marks indicating the nett weight of the butter contained therein, and the said marks shall be plainly printed in block capital letters and figures of dimensions not less than one-quarter of an inch high."

7. Paragraph (d) of Regulation 6 of the Principal Order is hereby revoked.

8. The Second Schedule to the Principal Order is hereby amended by the deletion of the word " bricks ".

9. The Third Schedule to the Principal Order is hereby amended by the deletion of sections I, II, III and IV thereof and the substitution therefor of the following new sections :—

" I. Design to indicate the manner in which the prescribed marks should be placed on packages packed on premises registered in the register of creameries or comprised in a subsisting licence granted under Section 42 of the Act.

A.—Stave of standard cask or keg.

B.—Side of standard box.

C.—Side of package containing butter packed in rolls.

II. Design to indicate the manner in which the prescribed marks should be placed on packages packed on premises registered in the register of manufacturing exporters and not comprised in a subsisting licence granted under Section 42 of the Act.

III. Design to indicate the manner in which the prescribed marks should be placed on packages packed on premises registered in the register of butter factories.

IV. Design to indicate the manner in which the prescribed marks should be placed on packages containing butter to which clause (iv) of paragraph (c) of sub-section (1) of Regulation 5 of this order applies.

10. The Dairy Produce Act, 1924 (Regulations under Part III) (Amendment) Order No. 2, 1936 (Statutory Rules and Orders No. 394 of 1936) is hereby revoked.
