WHEREAS it is enacted by sub-section (1) of Section 118 of the Road Traffic Act, 1933 (No. 11 of 1933), that the Commissioner of the Gárda Síochána may, with the consent of the Minister for Local Government and Public Health and after consultation with the local authority concerned, make in respect of any specified area bye-laws for all or any of the purposes mentioned in that sub-section :

AND WHEREAS the Commissioner of the Gárda Síochána has, before making the bye-laws hereinafter set forth, consulted the Lord Mayor, Aldermen, and Burgesses of Cork, and the Council of the County of Cork, in regard thereto :

NOW, I, MÍCHEÁL Ó CUINNEÁIN, Commissioner of the Gárda Síohcána, in exercise of the powers conferred on me by sub-section (1) of Section 118 of the Road Traffic Act, 1933 (No. 11 of 1933), and of every and any other power me in this behalf enabling, hereby, with the consent of the Minister for Local Government and Public Health testified by his official seal affixed hereto, make the following bye-laws in respect of the area consisting of the County Borough of Cork together with such portion of the County of Cork as lies within a circle with a radius of three miles having its centre at the principal Post Office at Oliver Plunkett Street in the City of Cork, that is to say :—

PART I. PRELIMINARY.

1 Short title.

1. These bye-laws may be cited as the Cork Large Public Service Vehicles Bye-Laws, 1939.

2 Interpretation.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these by-laws.

3 Definitions.

3.—(1) In these bye-laws,

the expression " the Commissioner " means the Commissioner of the Gárda Síochána,

the expression " the Act " means the Road Traffic Act, 1933 (No. 11 of 1933),

the expression " appointed stand " means a place which is, by virtue of these bye-laws, an appointed stand for large public service vehicles within the meaning and for the purpose of section 118 of the act,

the expression " appointed stopping place " means a place which is by virtue of these bye-laws, an appointed stopping place for large public service vehicles, that is to say, a point at which such vehicles may stop for the purpose of taking up or setting down passengers within the meaning and for tile purposes of paragraph (j) of sub-section (1) of section 118 of the act,

the word " stop " means to bring to a stand-still and does not mean or include to keep stationary, and the words " stopped " and " stopping " shall be construed accordingly.

(2) In the First Schedule to these bye-laws,

the expression " long-distance route " means a route from and to any appointed stand which is not more than one half mile from the principal Post Office at Oliver Plunkett Street, Cork, to and from a place which is more than three miles from the said principal Post Office.

PART II. APPOINTED STANDS.

4 Appointed stands.

4.—(1) Each of the several places specified in the second column of the First Schedule to these bye-laws shall be an appointed stand for large public service vehicles within the meaning and for the purposes of section 118 of the act.

(2) The following provisions shall apply and have effect in relation to the use of appointed stands as stands or starting-places for large public service vehicles, that is to say :—

(a) every appointed stand shall be available only for large public service vehicles plying on the route or any of the routes mentioned in the sixth column of the First Schedule to these bye-laws opposite the mention of such appointed stand in the second column of the said First Schedule ;

(b) no appointed stand shall be used as a stand or starting-place for any large public service vehicles other than the vehicles for which it is declared by the next preceding paragraph to be available, and no large public service vehicle other than as aforesaid shall be brought into or stopped in such appointed stand ;

(c) the number stated in the third column of the said First Schedule opposite the mention of an appointed stand in the second column of that Schedule shall be the maximum number of large public service vehicles which may be in such appointed stand at any one time ;

(d) whenever there is in an appointed stand the maximum number (within the meaning of the next preceding paragraph) of large public service vehicles, no person shall bring or attempt to bring or stop or attempt to stop any other large public service vehicle into or in such appointed place ;

(e) the period of time mentioned in the fourth column of the said First Schedule opposite the mention of an appointed stand in the second column of that Schedule shall be the maximum time during which a large public service vehicle may remain in such appointed stand ;

(f) no person shall keep or leave a large public service vehicle in an appointed stand for any continuous period exceeding the time which is the maximum time (within the meaning of the next preceding paragraph) during which such vehicle may remain in such appointed stand ;

(g) every large public service vehicle which is lawfully driven into an appointed stand shall be driven into, kept in, and driven out of such appointed stand in accordance in all respects with the directions set forth in the fifth column of the said First Schedule opposite the mention of such appointed stand in the second column of that Schedule

5 Temporary alteration of appointed stands.

5.—(1) Whenever the Commissioner is of opinion, that owing to street repairs, a public procession, a special concourse or diversion of traffic, or any other reason, an appointed stand is temporarily unsuitable or not available, in whole or in part, for use as a stand or starting-place for large public service vehicles, the Commissioner may, by notice in writing to the owner or owners of the large public service vehicles for which such appointed stand is under these bye-laws available as a stand or starting place, either, as he shall think proper in the circumstances, alter the limits of such appointed stand or appoint another place to be used as a stand or starting-place for large public service vehicles instead of such appointed stand.

(2) Whenever the Commissioner, by a notice under this bye-law, alters the limits of an appointed stand or appoints another place to be used instead of such appointed stand, such alteration or appointment shall, so long as such notice continues in force, have effect as if it were an amendment of the second column of the First Schedule to these bye-laws, and these bye-laws shall apply and have effect accordingly.

(3) Every notice given by the Commissioner under this bye-law shall contain a statement of the time during which such notice will continue in force, and every such notice shall continue in force for the time so stated, but the Commissioner may, by a notice similarly given before the expiration of the said time, extend or reduce the said time.

6 Prohibition of use of unauthorised stands and starting places.

6. No person shall use as a stand or starting-place for any large public service vehicle any place in the area consisting of the County Borough of Cork together with such portion of the County of Cork as lies within a circle with a radius of three miles having its centre at the principal Post Office at Oliver Plunkett Street in the City of Cork other than the places specified in the second column of the First Schedule to these bye-laws.

7 Prohibition or obstruction of appointed stands.

7. No vehicle which is not a large public service vehicle shall be brought into or stopped or kept or left stationary in an appointed stand, and no vehicle whatsoever shall be stopped or kept or left stationary in any such place or position in the vicinity of an appointed stand as would obstruct the use of such appointed stand as a stand or starting-place for the large public service vehicles for which it is declared by these bye-laws to be available.

8 Prohibition of loitering at appointed stands.

8. No person shall loiter at or in the immediate vicinity of an appointed stand or cause obstruction or annoyance to passengers in a large public service vehicle in such appointed stand or to persons alighting or who have alighted from any such vehicle or to persons awaiting transport in a large public service vehicle using such appointed stand as a starting-place.

PART III. APPOINTED STOPPING PLACES.

9 Appointed stopping places.

9.—(1) At each of the several places mentioned in the third or the fifth column of the Second Schedule to these bye-laws opposite the mention of a street or road in the first column of the said Schedule, the space hereinafter mentioned at such place (whether such space is or is not demarcated by the council charged with the maintenance of such street or road by means of painted or studded lines) shall be an appointed stopping place, that is to say, the space situate on the side of such street or road indicated in that behalf in such third or fifth column (as the case may be) and adjoining the footway or edge thereof and extending in length along such footway or edge for thirty feet on each side of such place and in breadth throughout ten feet outwards from such edge or footway.

(2) Every appointed stopping place in any street or road shall be an appointed stopping place only on that side of such street or road which is indicated in that behalf in the third column or the fifth column (as the case may be) of the Second Schedule to these bye-laws.

(3) A large public service vehicle proceeding along a street or road mentioned in the first column of the Second Schedule to these bye-laws may be stopped for the purpose of taking up or of setting down or of both taking up and setting down passengers at any appointed stopping place on that side of such street or road which is to the left of the driver of such vehicle, and shall not be stopped for any of the said purposes at any other place in such street or road.

(4) A large public service vehicle which is lawfully stopped at an appointed stopping place for the purpose of taking up or of setting down or of both taking up and setting down passengers shall not, without reasonable cause, be kept stationary at such appointed stopping place for any longer time than is necessary for such purpose.

(5) Every large public service vehicle which is stopped at an appointed stopping place shall be stopped on the side of the roadway which is to the left of the driver of such vehicle.

(6) A large public service vehicle shall not be stopped for the purpose of taking up or of setting down or of both taking up and setting down passengers in a street or road which is not mentioned in the first column of the Second Schedule to these bye-laws.

10 Temporary alteration of appointed stopping places.

10.—(1) Whenever the Commissioner is of opinion that, owing to street repairs, a public procession, a special concourse or diversion of traffic, or any other reason, an appointed stopping place is temporarily unsuitable for use as a stopping place for large public service vehicles, the Commissioner may, by notice in writing to the owner or owners of the large public service vehicles for the use of which such appointed stopping place is appointed by these bye-laws, appoint another place to be used by such vehicles as a stopping place instead of such appointed stopping place.

(2) Whenever the Commissioner, by a notice under this bye-law, appoints another place to be used as a stopping place instead of an appointed stopping place, such appointment shall, so long as such notice continues in force, have effect as if it were an amendment of the Second Schedule to these bye-laws, and these bye-laws shall apply and have effect accordingly.

(3) Every notice given by the Commissioner under this bye-law shall contain a statement of the time during which such notice will continue in force, and every such notice shall continue in force for the time so stated, but the Commissioner may, by a notice similarly given before the expiration of the said time, extend or reduce the said time.

PART IV. GENERAL.

11 Control of public at appointed stands and appointed stopping places.

11. Persons alighting or who have alighted from a large public service vehicle at an appointed stand or at an appointed stopping place and persons waiting at or in the vicinity of an appointed stand or an appointed stopping place for transport in a large public service vehicle shall behave in an orderly manner and shall comply with all directions (including, in the case of persons waiting, as aforesaid, a direction to form a queue) given by a member of the Gárda Síochána on duty at such place or by an official in the employment of the owner of such vehicle acting within the scope of his employment.

WHEREAS in pursuance of Section 8 of the Road Traffic Act, 1933 , the Commissioner has submitted the foregoing bye-laws to the Minister for Local Government and Public Health ; AND WHEREAS the provisions of sub-sections (1) and (5) of Section 8 have been complied with in relation to the said bye-laws ; NOW THEREFORE the Minister for Local Government and Public Health in exercise of the power conferred on him by Section 118 of the said Act hereby consents to the making of the said bye-laws.
