DUNGARVAN HARBOUR (TEMPORARY INCREASE OF CHARGES) ORDER, 1926, AMENDMENT ORDER, 1936.

THE DUNGARVAN HARBOUR (TEMPORARY INCREASE OF CHARGES) ORDER, 1926, AMENDMENT ORDER, 1936, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE ON THE 22nd DAY OF SEPTEMBER, 1936, PURSUANT TO SUB-SECTION (2) OF SECTION 3 of THE HARBOURS (REGULATION OF RATES) ACT, 1934 .

WHEREAS the Dungarvan Harbour (Temporary Increase of Charges) Order, 1926, is, by virtue of section 2 of the Harbours, Docks and Piers (Charges) Act, 1936 , to be deemed to be an order made as of its actual date by the Minister for Industry and Commerce, under sub-section (1) of section 3 of the Harbours (Regulation of Rates) Act, 1934 :

AND WHEREAS the Minister for Industry and Commerce is empowered by sub-section (2) of section 3 of the last mentioned Act to revoke or amend by order a harbour rates order:

AND WHEREAS the Dungarvan Urban District Council being the harbour authority in respect of the harbour of Dungarvan have applied pursuant to section 4 of the Harbours (Regulation of Rates) Act, 1934 , to the Minister for Industry and Commerce for an order amending the said Dungarvan Harbour (Temporary Increase of Charges) Order, 1926, by the substitution in the schedule to that Order, of a rate of 6d. per ton in respect of Coals and Culm, a rate of 8d. per ton in respect of Flour and a rate of 8d. per ton in respect of Grain, in lieu of the existing respective rates of 4½d. per ton, 7d. per ton and 7d. per ton:

AND WHEREAS the Minister for Education, acting as agent for the Minister for Industry and Commerce has pursuant to the provisions of sub-section (l) of section 5 of the Harbours (Regulation of Rates) Act, 1934 , given notice dated 4th day of August, 1936, of his proposal to make such order to the Dungarvan Urban District Council as such harbour authority and has given the directions mentioned in that sub-section in respect of the notice required thereby to be published by the said Council:

AND WHEREAS the Dungarvan Urban District Council, as such harbour authority, have duly published such notice, and such notice has contained the directions mentioned in sub-section (2) of section 5 of the said Act as regards making objections and representations to the Minister for Industry and Commerce in respect of such proposed order:

NOW THEREFORE the Minister for Education, acting as Agent for the Minister for Industry and Commerce, in exercise of the powers conferred on the Minister for Industry and Commerce by sub-section (2) of section 3 of the Harbours (Regulation of Rates) Act, 1934 , and of every and any other power him in this behalf enabling hereby orders as follows, that is to say—

1. This Order may be cited for all purposes as the Dungarvan Harbour (Temporary Increase of Charges) Order, 1926, Amendment Order, 1936.

2. The Interpretation Act, 1923 , applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. The Schedule to the Dungarvan Harbour (Temporary Increase of Charges) Order, 1926, shall be and it is hereby amended by the substitution of the figure 6d. for the existing figures 4½d. in respect of Coals and Culm, and by the substitution of the figure 8d. for the existing figure 7d. in respect of Flour, and by the substitution of the figure 8d. for the existing figure 7d. in respect of Grain, and the said Order shall be construed and have effect accordingly.
