DAIRY PRODUCE (PRICE STABILISATION) ACT (FORMS) REGULATIONS, 1935.

WHEREAS it is enacted by sub-section (1) of Section 4 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may by order make regulations prescribing any matter or thing referred to in the said Act as prescribed or to be prescribed:

AND WHEREAS the matters or things to which these regulations relate are matters and things which are referred to in the said Act as prescribed or to be prescribed:

NOW, I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:—

1. These Regulations may be cited for all purposes as the Dairy Produce (Price Stabilisation) Act (Forms) Regulations, 1935.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. (1) In these Regulations—

the expression "the Act" means the Dairy Produce (Price Stabilisation) Act, 1935 ;

the expression "the Minister" means the Minister for Agriculture.

(2) All references to registers shall, unless the context otherwise requires, be construed as references to the registers kept by the Minister in pursuance of Part II of the Act.

4. Every application made under the Act and mentioned in these Regulations shall be sent to the Minister by being sent by post to the Secretary, Department of Agriculture, Dublin.

5. Every application made under Section 7 of the Act for registration in the register of producers of non-creamery butter, shall be in the Form P.S. 1, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for registration in the said register.

6. Every application made under Section 7 of the Act for registration in the register of distributors of non-creamery butter shall be in the Form, P.S. 2, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such form shall be complied with by every person who applies for registration in the said register.

7. Every application made under Section 8 of the Act for the renewal of registration in the register of producers of non-creamery butter shall be in the Form, P.S. 3, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such form shall be complied with by every person who applies for the renewal of registration in the said register.

8. Every application made under Section 8 of the Act for the renewal of registration in the register of distributors of non-creamery butter shall be in the Form, P.S. 4, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such form shall be complied with by every person who applies for the renewal of registration in the said register.

9. Every application made under Section 8 of the Act for the renewal of registration in either of the registers kept by the Minister in pursuance of Part II of the Act, shall be made in accordance with these Regulations so as to reach the Minister not later than the 1st day of January in any year.

10. Every application made under sub-section (1) of Section 16 of the Act for an exemption licence shall be in the Form, P.S. 5, set forth in the Schedule hereto.

11. The particulars which are required by these Regulations to be sent to the Minister by the persons mentioned in these Regulations shall relate to and be in respect of the period of one month ending on the last day of the month to which such particulars relate, and shall be sent to the Minister by being sent by post to the Secretary, Department of Agriculture, Dublin, so as to reach the said Secretary not later than the seventh day of the month following the month to which such particulars relate.

12. Every registered proprietor of creamery premises shall send to the Minister the particulars specified in or required by the Form, P.S. 6, set forth in the Schedule hereto.

13. Every person registered in the register of producers of non-creamery butter shall send to the Minister the particulars specified in or required by the Form, P.S. 7, set forth in the Schedule hereto.

14. Every person registered in the register of distributors of non-creamery butter who is also registered in the register of butter factories kept under the Dairy Produce Act, 1924 , shall send to the Minister the particulars specified in or required by the Form, P.S. 8, set forth in the Schedule hereto.

15. Every person registered in the register of distributors of non-creamery butter who is also registered in the register of non-manufacturing exporters kept under the Dairy Produce Act, 1924 , shall send to the Minister the particulars specified in or required by the Form, P.S. 9, set forth in the Schedule hereto.

16. Every person registered in the register of distributors of non-creamery butter who is not registered in any of the registers kept under the Dairy Produce Act, 1924 , shall send to the Minister the particulars specified in or required by the Form, P.S. 10, set forth in the Schedule hereto.

17. Every person who is liable under Part III of the Act to pay a levy on any of the following milk products, tinned cream, raw cheese, processed cheese, condensed milk or dried or powdered milk, shall send to the Minister the particulars specified in or required by the Form, P.S. 11, set forth in the Schedule hereto.

18. Every person who is liable under Part III of the Act to pay a levy on bulk cream, shall send to the Minister the particulars specified in or required by the Form, P.S. 12, set forth in the Schedule hereto.

19. Every application made under sub-section (2) of Section 24 of the Act for a licence to import butter, shall be in the Form, P.S. 13, set forth in the Schedule hereto.

20. Every application made under sub-section (1) of Section 30 of the Act for a licence to import dairy produce, shall be in the Form, P.S. 14, set forth in the Schedule hereto.

21. Every application made under sub-section (1) of Section 32 of the Act for a licence to export butter, shall be in the Form, P.S. 15, set forth in the Schedule hereto.

22. Every application made under sub-section (1) of Section 32 of the Act for a licence to export a milk product, shall be in the Form, P.S. 16, set forth in the Schedule hereto.

23. Every application made under Section 36 of the Act by a person who claims to be entitled to a bounty under Part VII of the Act, shall be in the Form P.S. 17, set forth in the Schedule hereto, and shall contain or be accompanied by the particulars and documents specified in or required by the said form relating to the claim for such bounty.

24. The records which shall be kept under sub-section (1) of Section 45 of the Act by every registered proprietor of creamery premises, shall be in the Forms, P.S. 18A, P.S. 18B, P.S. 18C and P.S. 18D set forth in the Schedule hereto, and the entries which shall be made by every such registered proprietor in the said records, shall be such as are indicated in the said forms.

25. The records which shall be kept under sub-section (1) of Section 45 of the Act by every person registered in the register of producers of non-creamery butter, shall be in the Forms, P.S. 19A and P.S. 19B set forth in the Schedule hereto, and the entries which shall be made, by every such registered producer in the said records shall be such as are indicated in the said forms.

26. The records which shall be kept under sub-section (1) of Section 45 of the Act by every person registered in the register of distributors of non-creamery butter, shall be in the Forms, P.S. 20A, P.S. 20B and P.S. 20C, set forth in the Schedule hereto, and the entries which shall be made by every such registered distributor in the said records, shall be such as are indicated in the said forms.

27. The records which shall be kept under sub-section (1) of Section 45 of the Act by every manufacturer of tinned cream, raw cheese, processed cheese, condensed milk and dried milk or powdered milk by whom levies are payable or to whom bounties are payable under the Act, shall be in the Forms, P.S. 21A, P.S. 21B and P.S. 21C, set forth in the Schedule hereto, and the entries which shall be made by every such manufacturer in the said records shall be such as are indicated in the said forms.

28. The records which shall be kept under sub-section (1) of Section 45 of the Act by every manufacturer of bulk cream by whom levies are payable or to whom bounties are payable under the Act, shall be in the Forms, P.S. 22A and P.S. 22B, set forth in the Schedule hereto, and the entries which shall be made by every such manufacturer in the said records shall be such as are indicated in the said forms.

29. (1) Every entry required to be made by these Regulations by the registered proprietor of creamery premises in the record of butter manufactured by such proprietor, shall be made immediately after the completion of each churning.

(2) Every other entry required to be made by these Regulations by any person in any other record shall be made not later than six hours after the doing of the thing to which such entry relates.
