AN ACT TO AMEND THE AGRICULTURAL PRODUCE (FRESH MEAT) ACT, 1930 . [6th August, 1935.]

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

Definitions.

1.—(1) In this Act the expression “the Principal Act” means the Agricultural Produce (Fresh Meat) Act, 1930 (No. 10 of 1930).

(2) Every word and expression used in this Act to which a particular meaning is given by the Principal Act for the purposes of the Principal Act has in this Act the meaning so given to it.

Exemption from or reduction of exporter's half-yearly fees in certain cases.

2.—The Minister may, with the consent of the Minister for Finance, if he thinks fit, from time to time direct, in relation to any specified registered cattle slaughtering premises and in respect of any specified half-year, that—

(a) in the case of any person who held during such half-year or any part thereof a beef exporter's licence in respect of such specified premises and who held during such half-year or any part thereof no other exporter's licence, no exporter's half-yearly fee under section 13 of the Principal Act shall be payable in respect of any cattle presented under such beef exporter's licence to a veterinary examiner for examination at such specified premises during such half-year, and

(b) in the case of any person who held during such half-year or any part thereof a beef exporter's licence in respect of such specified premises and who held during such half-year or any part thereof any other exporter's licence (including a beef exporter's licence in respect of other premises), the exporter's half-yearly fee payable by such person under the said section 13 shall not include any sum in respect of any cattle presented under such first-mentioned beef exporter's licence to a veterinary examiner for examination at such specified premises during such half-year,

and any such direction shall, notwithstanding anything contained in the said section 13 or the Schedule to the Principal Act, have effect in accordance with the terms thereof.

Cesser in force of certain exporters' licences.

3.—(1) Where premises registered in the register of cattle slaughtering premises have ceased to be so registered, every beef exporter's licence granted in respect of such premises shall, immediately upon such cesser, cease to be in force.

(2) Where premises registered in the register of pig slaughtering premises have ceased to be so registered, every pork exporter's licence granted in respect of such premises shall, immediately upon such cesser, cease to be in force.

(3) Where premises registered in the register of sheep slaughtering premises have ceased to be so registered, every mutton exporter's licence granted in respect of such premises shall, immediately upon such cesser, cease to be in force.

(4) Where premises registered in the register of horse slaughtering premises have ceased to be so registered, every horse-flesh exporter's licence granted in respect of such premises shall, immediately upon such cesser, cease to be in force.

(5) Where premises registered in the register of goat slaughtering premises have ceased to be so registered, every goat-flesh exporter's licence granted in respect of such premises shall, immediately upon such cesser, cease to be in force.

(6) Paragraph (b) of sub-section (2) of section 16 of the Principal Act is hereby repealed.

Preservation of superannuation rights of certain veterinary officers of local authorities.

4.—(1) A veterinary officer of a local sanitary authority who is authorised under section 39 of the Principal Act to exercise and perform the powers and duties conferred or imposed by the Principal Act on a veterinary examiner shall not, if he was a pensionable officer, within the meaning of Part IV of the Local Government Act, 1925 (No. 5 of 1925), or within the meaning of any other enactment relating to the superannuation of officers of local authorities, at the time of such authorisation, cease to be a pensionable officer, within the meaning of the said Part IV, or such other enactment, by reason only of his devoting part of his time to the exercise and performance of the said powers and duties.

(2) This section shall have and be deemed to have had effect as from the passing of the Principal Act.

Minor amendments of the Principal Act.

5.—The Principal Act shall be construed and have effect as if each section and sub-section mentioned in the first column of the Schedule to this Act were respectively amended in the manner set out in the second column of that Schedule opposite such section and sub-section respectively.

Expenses.

6.—All expenses incurred by the Minister in carrying this Act into effect shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title and citation.

7.—This Act may be cited as the Agricultural Produce (Fresh Meat) (Amendment) Act, 1935, and the Agricultural Produce (Fresh Meat) Acts, 1930 and 1931, and this Act may be cited together as the Agricultural Produce (Fresh Meat) Acts, 1930 to 1935.

MINOR AMENDMENTS OF THE PRINCIPAL ACT.

Section and sub-section of the Principal Act

How Amended

Section 35 .

(i) By the deletion in paragraph (d) of the words “free from disease” and the insertion in lieu thereof of the words “fit for human consumption”.

(ii) By the deletion in paragraph (e) of the words “and wholesome” and the insertion in lieu thereof of the words “wholesome and in a satisfactorily marketable condition”.

Section 36 .

By the deletion of the words “and so informs such veterinary examiner, such” and the insertion in lieu thereof of the words “and so informs any veterinary examiner, that”.

Section 40 , sub-section (2).

(i) By the deletion in paragraph (b) of the words “veal and offals” and the insertion in lieu thereof of the words “and veal”.

(ii) By the insertion at the end of paragraph (b) of the word “and”.

(iii) By the insertion at the end of the sub-section of the following new paragraph—

“(c) such offals shall be exported direct from registered cattle slaughtering premises by a person who is the holder of a beef exporter's licence.”

Section 40 , sub-section (3).

(i) By the deletion in paragraph (b) of the words “and offals shall be exported direct from the registered pig slaughtering premises in which they were” and the insertion in lieu thereof of the words “shall be exported direct from the registered pig slaughtering premises in which it was”.

(ii) By the insertion at the end of paragraph (b) of the word “and”.

(iii) By the insertion at the end of the sub-section of the following new paragraph—

“(c) such offals shall be exported direct from registered pig slaughtering premises by a person who is the holder of a pork exporter's licence.”

Section 40 , sub-section (4).

(i) By the deletion in paragraph (b) of the words “lamb and offals” and the insertion in lieu thereof of the words “and lamb”.

(ii) By the insertion at the end of paragraph (b) of the word “and”.

(iii) By the insertion at the end of the sub-section of the following new paragraph—

“(c) such offals shall be exported direct from registered sheep slaughtering premises by a person who is the holder of a mutton exporter's licence.”

Section 40 , sub-section (5).

(i) By the deletion in paragraph (b) of the words “and offals shall be exported direct from the registered horse slaughtering premises in which they were” and the insertion in lieu thereof of the words “shall be exported direct from the registered horse slaughtering premises in which it was.”

(ii) By the insertion at the end of paragraph (b) of the word “and.”

(iii) By the insertion at the end of the sub-section of the following new paragraph—

“(c) such offals shall be exported direct from registered horse slaughtering premises by a person who is the holder of a horse-flesh exporter's licence.”

Section 40 , sub-section (6).

(i) By the deletion in paragraph (b) of the words 1and offals shall be exported direct from the registered goat slaughtering premises in which they were” and the insertion in lieu thereof of the words “shall be exported direct from the registered goat slaughtering premises in which it was.”

(ii) By the insertion at the end of paragraph (b) of the word “and.”

(iii) By the insertion at the end of the sub-section of the following new paragraph—

“(c) such offals shall be exported direct from registered goat slaughtering premises by a person who is the holder of a goat-flesh exporter's licence.”
