ROAD TRAFFIC BYE-LAWS ORDER, 1934.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH. ROAD TRAFFIC ACT, 1933 .

The Minister for Local Government and Public Health, in exercise of the powers conferred on him by sub-sections (1) and (3) of Section 8 of the Road Traffic Act, 1933 (in this Order referred to as " the Act ") hereby orders and prescribes as follows, that is to say :

1. This Order may be referred to as The Road Traffic Bye-Laws Order, 1934.

2. Every bye-law made by the Commissioner under the Act which is required by the Act to be made with the consent of the Minister shall be submitted to the Minister in the following manner, that is to say :—

(1) Two copies of such bye-law signed by the Commissioner shall be transmitted to the Minister for his consideration,

(2) Where the bye-law is required by the Act to be made after consultation with the local authority concerned, the copies referred to in the foregoing paragraph shall be accompanied by such evidence as shall satisfy the Minister that the requirements of sub-section 5 of Section 8 of the Act have been complied with.

3. When the Commissioner makes any bye-laws under the Act and such bye-laws are approved by the Minister, such bye-laws shall be published in accordance with the following rules, that is to say :

(1) The Commissioner shall publish in each of three newspapers circulating in the area in which the bye-laws, are to have effect (of which one at least shall be a daily newspaper) two notices of the making of the bye-laws, in accordance with these rules.

(2) The two notices required by the foregoing rule shall be published in successive weeks.

(3) Every notice of the making of bye-laws published in accordance with these rules shall contain the following, that is to say :—

(a) a statement that bye-laws have been made by the Commissioner and under what section or sections of the Act;

(b) a statement that copies of the bye-laws have been deposited at every station of the Gárda Síochána which is situated in any county, county borough, borough or urban district in which the bye-laws are to have effect and the days and hours at which such copies may be inspected at such stations;

(c) a statement of the place or places at which printed copies of the bye-laws are on sale and the price to be charged for such copies.

(4) Before the publication of the notices of the making of the bye-laws in accordance with these rules a copy of the bye-laws shall be deposited by the Commissioner in every station of the Gárda Síochána which is situated in any county, county borough, borough or urban district in which the bye-laws are to have effect, and every person applying at any such station on any day (not being a Sunday or a bank holiday), between the hours of 10 a.m. and 5 p.m., shall be permitted to inspect such copy.

(5) In addition to the arrangements made under the foregoing rule the Commissioner shall arrange before the publication of the notices of the bye-laws in accordance with these rules for the sale of printed copies of the bye-laws.

(6) For the purposes of these rules, a borough or urban district shall be deemed not to form part of the County in which it is situated.
