STATUTORY RULES AND ORDERS. 1934. No. 288.

CONTROL OF IMPORTS (QUOTA No. 9) ORDER, 1934.

WHEREAS it is enacted by section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), that the Executive Council may at any time by order (in that Act called a quota order) prohibit, subject to the provisions of the said Act, the importation into Saorstát Eireann on or after a specified day (in that Act referred to as the commencement of such order) not prior to the date of such order of any particular description or descriptions of goods, and that the Executive Council shall, in and by every quota order, appoint the day (not more than six weeks after the commencement of such order) on which the first quota period under such quota order shall commence :

NOW, the Executive Council, in exercise of the powers conferred on them by section 3 of the Control of Imports Act, 1934 (No. 12 of 1934), and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited for all purposes as the Control of Imports (Quota No. 9) Order, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In this Order—

the expression " the Act ", means the Control of Imports Act, 1934 (No. 12 of 1934),

the expression " motor car " means a mechanically propelled vehicle which derives its motive power from an internal combustion engine or from an electric motor or from a combination of such engine and such motor, but does not include a bicycle or a tricycle, nor a vehicle which is, in the opinion of the Revenue Commissioners, designed and constructed solely or primarily for the traction of vehicles or other articles or for propulsion along rail tracks, nor any vehicle which is shown to the satisfaction of the Revenue Commissioners to be intended for propulsion along rail tracks.

4. Subject to the exceptions and qualifications mentioned in the next following paragraph of this Order, the importation into Saorstát Eireann on or after the 20th day of October, 1934, of any motor car chassis which is imported without a body or body shell attached thereto and is, in the opinion of the Revenue Commissioners, completely or substantially assembled is hereby prohibited.

5. The prohibition effected by the next preceding paragraph of this Order shall not extend or apply to any article which—

(a) is imported under and in accordance with a licence in that behalf issued under the Act, or

(b) is an article to which this Order is precluded by subsection (4) of section 3 of the Act from applying.

6. The 26th day of November, 1934, is hereby appointed to be the day on which the first quota period under this Order shall commence.
