STATUTORY RULES AND ORDERS. 1934. No. 224.

HORSE BREEDING REGULATIONS, 1934.

WHEREAS it is enacted by subsection (1) of section 30 of the Horse Breeding Act, 1934 (No. 3 of 1934), that the Minister for Agriculture may by order make regulations in relation to any matter or thing referred to in the said Act as prescribed or to be prescribed, but that no such regulations shall be made in relation to the amount or collection of fees without the consent of the Minister for Finance:

AND WHEREAS the matters and things to which these Regulations relate are referred to in the said Act as prescribed or to be prescribed

NOW, THEREFORE, I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by section 30 of the Horse Breeding Act, 1934 (No. 3 of 1934), and of every and any other power me in this behalf enabling, and, in so far as these Regulations relate to the amount or collection of fees, with the consent of the Minister for Finance, testified by his signature hereto, hereby order and make the following Regulations, that is to say:—

1 Short Title.

1. These Regulations may be cited for all purposes as the Horse Breeding Regulations, 1934.

2 Interpretation.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3 Definition.

3. In these Regulations the expression "the Act" means the Horse Breeding Act, 1934 (No. 3 of 1934).

4 Application of the Act.

4. For the purposes of section 3 of the Act, the expression "the prescribed age" shall mean the age of two years, and a stallion shall be deemed to have attained that age on the 1st day of January in the second calendar year after that in which it was foaled.

5 Licences and renewals of licences to keep stallions.

5.—(1) Every application for a licence or a renewal of a licence under the Act—

(a) shall be made either—

(i) in the case of an application for a licence, in the form H.B.101 set out in the Schedule to these Regulations; or

(ii) in the case of an application for a renewal of a licence, in the form H.B.102 set out in the said Schedule;

(b) shall contain the appropriate particulars indicated in whichever of the said forms is used;

(c) shall be sent by post or delivered to "The Secretary, Department of Agriculture, Dublin, C.17";

(d) shall, unless accompanied by a special fee in accordance with paragraph (c) of subsection (1) of section 11 of the Act, be made not later than the 31st day of December in the year preceding that in respect of which such application is made.

6 Classification of stallions.

6. For the purpose of fixing licence fees, stallions shall be divided into the following classes, that is to say—

(a) stallions which do not exceed fourteen hands in height, in these Regulations referred to as pony stallions;

(b) stallions which have attained the age of seven years and in respect of which applications are made for renewals of licences in force for the three years preceding the year in respect of which such applications are made, in these Regulations referred to as aged stallions; and

(c) other stallions to which the Act applies.

7 Licence fees

7. The amount of the licence fee to accompany each application for a licence or a renewal of a licence under the Act shall, in the case of a pony stallion or an aged stallion, be half a guinea and shall, in the case of any other stallion to which the Act applies, be one guinea.

8 Special fee.

8. The amount of the special fee to accompany each application for a licence or a renewal of a licence under the Act not made before the 31st day of December of the year preceding that in respect of which such application is made shall, in the case of an application in respect of a stallion which was not in Saorstát Eireann at any time during the six months preceding the said 31st day of December, be 5/- and shall, in every other case, be three pounds.

9 Issue of duplicate licence or new certified copy of licence on loss or destruction.

9. Where the Minister is satisfied that a licence or a certified copy of a licence under the Act has been lost or destroyed he may, on payment of a fee of two shillings and six pence, issue to the holder of such licence a duplicate of such licence or another certified copy of such licence (as the case may require) upon the holder of such licence undertaking in writing that, in the event of such licence or certified copy being subsequently discovered by him, he will forthwith forward such licence or certified copy to the Minister.

10 Diseases or defects rendering stallion unsuitable for breeding.

10. For the purposes of sections 13 and 14 of the Act, the following diseases or defects shall be diseases or defects rendering a stallion unsuitable for breeding purposes, that is to say—

cataract, roaring, whistling, broken wind, ringbone, sidebone, unsound feet, bone spavin, curb, shivering, stringhalt and defective genital organs.

11 Permits.

11.—(1) The fee to be paid for a permit under section 18 of the Act shall be five shillings.

(2) Every permit under section 18 of the Act shall be in the form H.B.103 set out in the Schedule to these Regulations and shall be subject to the condition that the stallion to which such permit relates shall not be used for service purposes.

12 Transfer of licences and permits.

12. Every applicant for a transfer of a licence or permit under the Act shall agree to hold such licence or permit subject to the same conditions as the original holder and the manner of transfer shall be either cancellation of such licence or permit and issue of a new licence or permit to the transferee or endorsement of such licence or permit with the name of the transferee.

13 Castration.

13. Notices under subsection (1) of section 23 of the Act requiring castration of a stallion shall be in the form H.B. 104 set out in the Schedule to these Regulations and shall be filled in with the appropriate particulars indicated in the said form.

14 Requisition for examination by a referee.

14.—(1) Where the Minister—

(a) refuses an application for a licence or permit under the Act or for the renewal of a licence under the Act, or

(b) refuses to transfer a licence or permit under the Act, or

(c) revokes or suspends a licence under the Act, or

(d) serves under the Act a notice requiring that a stallion be castrated,

the owner or any person keeping or having possession of the stallion to which such application, licence, permit or notice (as the case may be) relates may, within twenty-one days from the date on which notice of such refusal, revocation, suspension or requirement shall have been given to him, apply to the Minister in writing to have such stallion inspected and examined by a referee.

(2) Every application under this Regulation shall be accompanied by a fee of five guineas.

15 Duty to notify certain occurrences.

15. Where any person is the holder of a licence or permit granted under the Act and there occurs —

(a) any transfer (whether by sale or otherwise) or devolution of the property in the stallion to which such licence or permit relates, or

(b) any loan, lease or hiring of such stallion, or

(c) the castration of such stallion, or

(d) the death of such stallion,

such holder shall, on the day of such occurrence or the day following, send to the Minister, in the form H.B. 105 set out in the Schedule to these Regulations, the particulars relevant to such occurrence indicated in such form.

16 Particulars of events occasioning transfer.

16. The particulars to be furnished under paragraph (b) of subsection (1) of Section 21 of the Act by the holder of a licence or permit under the Act on or within three days after the happening of any event which would entitle any other person to obtain a transfer of such licence or permit shall be:—

(a) the name and address of such other person, and

(b) a detailed account of the event upon which such other person became so entitled.

17 Return to Minister of Licence or permit on termination thereof.

17. The time within which a licence or permit under the Act which has been terminated by suspension, revocation, effluxion of time, death, or castration of the stallion or otherwise shall be returned to the Minister, shall be the time between such termination and the expiration of three days after the date of such termination.

18 Recognised Stud Books

18. For the purposes of Section 5 of the Act the following shall be recognised stud books, that is to say:—

(a) The General Stud Book, published by Weatherby and and Sons, London, and

(b) The Stud Book Francais, published by the order of the French Minister of Agriculture, and

(c) The American Stud Book, published by the American Jockey Club, New York.

19 The list of exempted stallions.

19.—(1) The list of exempted stallions to be kept under section r of the Act shall be in the form H.B. 106 set out in the Schedule to these Regulations and for the purposes of subsection (1) of section 6 of the Act the prescribed particulars shall be such of the particulars indicated in the said form as may be appropriate.

(2) Every application made to the Minister requesting him to enter a stallion in the list of exempted stallions shall be made in the form H.B. 107 set out in the Schedule to these Regulations, shall contain the particulars indicated in the said form, shall be sent by post or delivered to "The Secretary, Department of Agriculture, Dublin, C.17," and shall be accompanied by a fee of two shillings and sixpence.

(3) The fee to be paid on inspection of the list of exempted stallions shall be one shilling.

(4) The fee to be paid on obtaining a certified copy of any entry in the list of exempted stallions shall be one shilling.

(5) The fee to be paid on obtaining a certificate that a stallion is not entered in the list of exempted stallions shall be one shilling.
