THE TEACHERS' PENSION RULES, 1934.

I, Tomas O Deirg, Minister for Education, in exercise of the powers conferred on me by the National School Teachers (Ireland) Act, 1879, and of any and every other power me in this behalf enabling, do hereby make the following Rules, that is to say:—

1. Notwithstanding anything contained in the Irish Teachers' Pension Rules, 1914, the following provisions shall have effect in relation to a teacher to whom those Rules apply who applies to retire in order to undertake an office in the Public Service to which he has been appointed by the Executive Council, that is to say:—

(a) a pension may be granted to such teacher if he has attained the age of fifty-five years, and has served for not less than thirty years;

(b) where the Minister for Education, with the consent of the Minister for Finance, directs that a period in respect of which salary was not paid to such teacher, and which, but for such non-payment of salary, would have been reckoned as service for the purposes of the said Rules, is to be reckoned as a period of service, such period may be reckoned as service for the purposes of the said Rules, provided that such teacher pays to the Superintendent of the Teachers' Pension Office the amount of the premiums which would have been payable by him if he had been paid salary in respect of such period.

2. Where a pension is awarded by virtue of Rule 1 of these Rules to a teacher appointed to an office in the Public Service by the Executive Council, the following provisions shall have effect in respect of any period during which he holds such office—

(a) if the profits of such office are not less than the average annual salary by reference to which such pension was computed, such pension shall not be paid;

(b) if such profits are less than such average annual salary, such pension shall be reduced to an amount equal to the difference between such profits and such average annual salary.

3. These Rules may be cited for all purposes as the Teachers' Pension Rules, 1934, and shall be construed as one with the Irish Teachers' Pensions Rules, 1914.
