STATUTORY RULES AND ORDERS. 1934. No. 107.

WILD BIRDS (COUNTY TIPPERARY, SOUTH RIDING) ORDER, 1934.

WHEREAS it is enacted by sub-section (1) of section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), that the Minister for Justice may by order, made on the application of the council of a county, prohibit for reasons stated in such application, the taking or destroying in such county of the eggs of any particular kinds of wild birds ;

AND WHEREAS the Council of the Administrative County of Tipperary, South Riding (acting by the Commissioner appointed to administer the affairs of the said County) has applied to the Minister for Justice for the making of an order prohibiting the taking or destroying in the County of Tipperary, South Riding, of the eggs of any of the following wild birds, that is to say :—peregrine falcon, harrier (all kinds), raven, kingfisher, heron, turtle dove, stock dove, grebe (all kinds), because those birds are, owing to the increase in the number of egg collectors, subject to great persecution, and of owls (all kinds), kestrel, and buzzard because they are of special utility as destroyers of rats and mice ;

NOW, therefore, I, P. J. Ruttledge, Minister for Justice, in exercise of the powers conferred on me by section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930) and of every and any other power me in this behalf enabling, do hereby order for the said reasons as follows :—

1. This Order may be cited for all purposes as the Wild Birds (County Tipperary. South Riding) Order, 1934.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. No person shall take or destroy in the County of Tipperary. South Riding, the eggs of any of the following wild birds, that is to say :—peregrine falcon, harrier (all kinds), raven, kingfisher, heron, turtle dove, stock dove, grebe (all kinds), owls (all kinds), kestrel, and buzzard.
