STATUTORY RULES AND ORDERS. 1931. No. 78.

VOCATIONAL EDUCATION (ACQUISITION OF LAND) REGULATIONS, 1931.

WHEREAS it is enacted by sub-section (1) of section 28 of the Vocational Education Act, 1930 (No. 29 of 1930), that a vocational education committee may, with the approval of the Minister for Education and subject to regulations made by him under that Act, purchase or take on lease any land for the purposes of any of their powers or duties under the said Act ;

NOW, I, JOHN MARCUS O'SULLIVAN, Minister for Education in exercise of the powers conferred on me by sub-section (1) of section 28 of the Vocational Education Act, 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling do hereby make the following regulations :—

1. These Regulations may be cited as the Vocational Education (Acquisition of Land) Regulations, 1931.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations, the expression " the Minister " means the Minister for Education, the word " committee " means a vocational education committee, and

the expression " the Act " means the Vocational Education Act, 1930 (No. 29 of 1930).

4. (1) Where a committee propose to purchase or to take on lease any land for the purposes of any of their powers or duties under the Act they shall apply to the Minister for his approval to the purchase of such land or the taking on lease of such land and shall furnish the Minister with a statement specifying—

(a) the area and situation of such land,

(b) the purpose or purposes for which such land is required,

(c) whether it is proposed

(i)to purchase such land by agreement, or

(ii) to acquire such land compulsorily, or

(iii) to take on lease such land,

(d) in the event of it being proposed to purchase such land by agreement,

(i) the title to such land,

(ii) the price proposed to be paid,

(iii) the manner in which the cost is to be met,

(e) in the event of it being proposed to acquire such land compulsorily—

(i) the reasons why it is not proposed to purchase such land by agreement,

(ii) the manner in which the cost is to be met,

(f) in the event of it being proposed to take on lease such land—

(i) the terms of such lease,

(ii) the amount of the rent to be reserved by such lease,

(iii) the covenants proposed to be inserted in such lease,

(g) such other information as the Minister may require.

(2) For the purposes of a statement under this Regulation a committee may enter into negotiations for the purchase or taking on lease of any land.
