STATUTORY RULES AND ORDERS. 1928. No. 4.

GEOLOGICAL SURVEY (RE-DISTRIBUTION OF PUBLIC SERVICES) ORDER, 1928.

WHEREAS it is enacted by sub-section (2) of section 12 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) that it shall be lawful for the Executive Council from time to time by order to re-distribute any of the public services and officers, and the administration, jurisdiction, powers, duties and functions thereof amongst the several Ministers and Departments of State or any of them in any manner which may seem to the Executive Council to be expedient or proper in the public interests, and to make such orders consequential on or necessary for giving effect to any such re-distribution as the Executive Council may consider expedient or proper:

AND WHEREAS by virtue of the Department of Agriculture and Technical Instruction for Ireland (Education) (Transfer of Functions) Order, 1927, made on the 13th day of December, 1927, by the Executive Council under sub-section (2) of section 9 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) the jurisdictions, powers, duties, and functions in relation to the Geological Survey in Ireland which were immediately before the date of the said Order vested in or conferred or imposed on the Department of Agriculture and Technical Instruction for Ireland by or under the Agriculture and Technical Instruction (Ireland) Act, 1899, or any other enactment are now vested in and conferred and imposed on the Minister for Education, and the public services and officers concerned with the said jurisdiction, powers, duties and functions are now comprised in and included in the public services and officers of the Department of Education:

AND WHEREAS it seems to the Executive Council to be expedient in the public interests that the public services and officers of the Minister for Education concerned with the Geological Survey in Ireland and the administration, jurisdiction, powers, duties and functions thereof should be re-distributed and transferred to the Minister for Industry and Commerce, and the Executive Council considers that the provisions hereinafter contained consequential on or necessary for giving effect to such re-distribution are expedient and proper:

NOW, the Executive Council of Saorstát Eireann in exercise of the power conferred on them by sub-section (2) of section 12 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) and of every and any other power them in this behalf enabling do hereby order as follows:—

1. This Order may be cited for all purposes as the Geological Survey (Redistribution of Public Services) Order, 1928.

2. This Order shall come into operation on the 1st day of April, 1928.

3. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in the like manner as it applies to the interpretation of an Act of the Oireachtas.

4. The public services and officers of the Minister for Education concerned with the Geological Survey in Ireland and the administration, jurisdiction, powers, duties and functions thereof are hereby transferred to the Minister for Industry and Commerce.

5. So much of paragraph 6 of the Department of Agriculture and Technical Instruction for Ireland (Education) (Transfer of Functions) Order, 1927, as relates to the jurisdictions, powers, duties and functions in relation to the Geological Survey in Ireland referred to in the said paragraph shall cease to have effect and in lieu thereof every mention or reference contained in any British Statute or in any order, rule or regulation made under such statute of or to the Department of Agriculture and Technical Instruction for Ireland in relation to the Geological Survey in Ireland shall be construed as a mention of or reference to the Minister for Industry and Commerce.
