SEED SUPPLY ACT, 1924.


AN ACT TO VALIDATE THE PROVISION OF SEED POTATOES OR SEED OATS OR BOTH SEED POTATOES AND SEED OATS BY COUNTY COUNCILS ON OR AFTER THE 1st DAY OF DECEMBER 1923 AND BEFORE THE 1st DAY OF DECEMBER 1924 AND BY CERTAIN RURAL DISTRICT COUNCILS ON OR AFTER THE 1st DAY OF DECEMBER 1921 AND BEFORE THE 1st DAY OF DECEMBER 1922, AND TO MAKE PROVISION FOR THE PAYMENT AND RECOVERY OF MONEYS IN RELATION TO SUCH SEED POTATOES AND SEED OATS, AND FOR OTHER PURPOSES CONNECTED WITH THE MATTERS AFORESAID. [18th December, 1924.]

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

Validation of supply of seed potatoes or seed oats by county councils.

1.—(1) Where the council of a county have or shall have, on or after the 1st day of December 1923 and before the 1st day of December 1924 and with the sanction of the Minister, provided a supply of seed potatoes or of seed oats or of both seed potatoes and seed oats for distribution in such county or in any particular portion thereof, it shall be lawful for such council to sell any of such seed potatoes or seed oats to any occupier or cultivator of land in such county or such particular portion thereof (as the case may be), and any sale made by such council before the passing of this Act of any such seed potatoes or seed oats to any such occupier or cultivator shall be deemed to be and always to have been legal and valid.

(2) Any sum owing to the council of a county in respect of any sale of any such seed potatoes or seed oats as aforesaid shall be paid to such council, at the option of the council, either at the time and in the manner agreed on at the time of the sale or by three equal instalments payable on the respective dates appointed for the purpose by the council, and in either case may be collected and recovered in the manner authorised by this Act.

Exemption from disqualification in certain cases.

2.—No person shall be or be deemed to have been disqualified for being elected, chosen, or being a member of the council of a county or district, or of a board of guardians, or of a board of town commissioners by reason of his having entered into or his hereafter entering into a contract for the purchase from the council of a county of any such seed potatoes or seed oats as are mentioned in the first section of this Act.

Validation of certain orders, regulations, etc.

3.—All orders and regulations made, sanctions given, and things done by the Minister in relation to the provision by the council of a county on or after the 1st day of December 1923 and before the 1st day of December 1924 of seed potatoes or seed oats or both seed potatoes and seed oats or the sale and distribution of such seed potatoes or seed oats shall be and be deemed always to have been legal and valid for all purposes.

Payment of certain sums due to certain rural district councils.

4.—Where any sum is due at the date of the passing of this Act by any person to any of the rural district councils mentioned in the Schedule to this Act in respect of seed potatoes or seed oats sold to him by such council on or after the 1st day of December 1921 and before the 1st day of December 1922 under a scheme approved of by the Minister under the Local Authorities (Indemnity) Act, 1923 (No. 49 of 1923) for the provision of seed potatoes or seed oats or both seed potatoes and seed oats by such council, such sum shall be paid by such person to the council of the county in which such rural district is situate and may be collected and recovered by such county council in the manner authorised by this Act.

Recovery of sums payable under this Act to county councils.

5.—(1) Any sum declared by this Act to be payable to the council of a county may, if the person by whom the same is payable is rated to the poor rate in that county, be levied by the council by a special rate to be added to and collected with the poor rate assessed on the tenement in respect of which such person is so rated as aforesaid.

(2) Any sum declared by this Act to be payable to the council of a county may, if the person by whom the same is payable is not rated to the poor rate in that county, be levied by means of a special rate to be made by such council for the purpose of this section to which such person shall be rated and which shall be collected and may be recovered in the same manner and by the same means as poor rate may be collected and recovered by that council.

Validation of borrowing of certain sums.

6.—(1) This section applies to all sums which—

(a) have been or shall be borrowed with the approval of the Minister by the council of a county on or after the 1st day of December 1923 and before the 1st day of December 1924 for the purpose of providing seed potatoes or seed oats or both seed potatoes and seed oats for distribution in such county or in any particular portion thereof, or

(b) have been borrowed with the approval of the Minister before the passing of this Act by the council of any of the rural districts mentioned in the Schedule to this Act for the purpose of defraying any liability incurred by such council in pursuance of a scheme approved of by the Minister under the Local Authorities (Indemnity) Act, 1923 (No. 49 of 1923) for the provision by such council of seed potatoes or seed oats or both seed potatoes and seed oats.

(2) Every sum to which this section applies shall be deemed to have been legally borrowed by the council by which the same was borrowed, and shall be repaid by such council on or before the 31st day of March 1926 with interest at the rate agreed upon.

(3) Every sum to which this section applies and the interest thereon at the rate aforesaid shall be deemed to be charged as from the date on which such sum was borrowed on the poor rate leviable in the county or rural district (as the case may be) of the council by which the same was borrowed.

Definition.

7.—In this Act the expression “the Minister” means the Minister for Local Government and Public Health.

Short title.

8.—This Act may be cited as the Seed Supply Act, 1924.
