LOCAL AUTHORITIES (EXTENSION OF TIME) ACT, 1923.


AN ACT TO ENABLE THE TIMES LIMITED BY SPECIAL ACTS OF THE PARLIAMENT OF THE LATE UNITED KINGDOM FOR THE EXECUTION OF PUBLIC WORKS BY LOCAL AUTHORITIES TO BE EXTENDED AND FOR OTHER PURPOSES CONNECTED THEREWITH. [29th March, 1923.]

WHEREAS powers of executing works of public utility have been conferred by divers Special Acts of the Parliament of the late United Kingdom of Great Britain and Ireland on certain Local Authorities in Saorstát Eireann:

AND WHEREAS in several such cases the Local Authorities have been prevented by circumstances beyond their control from executing the works aforesaid within the time limited for that purpose by the Special Acts and the powers conferred by such Acts have thereby expired or will shortly expire:

AND WHEREAS it is expedient that the works of public utility aforesaid should be carried out and completed and that for that purpose the time limited by such Special Acts should be extended so as to enable the powers thereby conferred to be exercised:

BE IT THEREFORE ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

Extension of time for exercising powers.

1.—(1) Wherever any powers have been conferred on a Local Authority by a Special Act and such powers are, by virtue of such Special Act, exercisable only during a period of time which expired within three years before the passing of this Act, or will expire within one year after the passing of this Act, it shall be lawful for the Minister on the application of such Local Authority by Order under his Seal to extend the period of time aforesaid to any date not being later than two years after the passing of this Act.

(2) If and whenever an Order is made by the Minister under this Act extending any such period of time as aforesaid, the Special Act by which such period of time was limited shall have effect as if the extended period of time named in such Order were substituted in such Special Act for the period of time actually mentioned therein.

Opportunity to be given to make representations.

2.—Before making an Order under this Act the Minister shall give all persons interested in the subject matter of such Order reasonable opportunity of making representations to him in relation thereto and for that purpose the Local Authority applying for such Order shall publish and give such notices in such newspapers and places and to such persons in such form and manner and at such times as the Minister shall direct.

Orders to be laid before the Oireachtas.

3.—Every Order made by the Minister under this Act shall be laid before each House of the Oireachtas forthwith and unless and until a resolution annulling such Order is passed by each House of the Oireachtas within the next subsequent twenty-one days on which either House has sat such Order shall have effect as if enacted in this Act, but no such resolution shall operate to prejudice the validity of anything previously done under such Order.

Definitions.

4.—In this Act

the expression “the Minister” means the Minister for Local Government;

the expression “Special Act” means and includes any local or personal Act of the Parliament of the late United Kingdom of Great Britain and Ireland and any Act of the Parliament aforesaid confirming a Provisional Order made by the Local Government Board for Ireland, and also means and includes any Public or General Act of the Parliament aforesaid which regulates the exercise of the powers or any of the powers conferred by any such local or personal Act or Act confirming a Provisional Order as aforesaid whether such Public or General Act is or is not incorporated in such local or personal Act or Act confirming a Provisional Order;

the expression “Local Authority” means and includes a County Council, a Council of a County Borough, Urban District Council, Rural District Council and the Commissioners of a Town.

Short Title.

5.—This Act may be cited as the Local Authorities (Extension of Time) Act, 1923.
