I, Timmy Dooley, Minister of State at the Department of Climate, Energy and the Environment, in exercise of the powers conferred on me by section 76 (2)(ii) of the Maritime Area Planning Act 2021 , and after consultation with the Maritime Area Regulatory Authority, hereby make the following regulations: | ||
Citation | ||
1. These Regulations may be cited as the Maritime Area Planning (Section 76) Regulations 2026. | ||
Relevant Class of Maritime Usage | ||
2. A class of usage which is authorised, or is required to be authorised, by a local authority in its functional area under – | ||
(a) section 199 of the Local Government Act 2001 ; | ||
(b) section 46 of the Control of Horses Act 1996 ; | ||
(c) section 17 of the Control of Dogs Act 1986 ; or | ||
(d) Part 16 of the Planning and Development Regulations 2001, | ||
and which takes place wholly or partly in its nearshore area, is hereby specified a class of maritime usage for the purposes of paragraph 9 of Schedule 4 of the Maritime Area Planning Act 2021 . | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
These Regulations specify certain activities for the purposes of paragraph 9 of Schedule 4 of the Principal Act and provide that a Maritime Area Consent (MAC) application is not required in respect of activities that are authorised by or under the specified enactments. |
