S.I. No. 163/2025 - European Union (Road Transport) (Working Conditions and Road Safety) (Amendment) Regulations 2025

I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Regulation (EC) No. 561/2006 of the European Parliament and of the Council of 15 March 20061 , as amended by Regulation (EU) 2024/1258 of the European Parliament and of the Council of 24 April 20242 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Road Transport) (Working Conditions and Road Safety) (Amendment) Regulations 2025. | ||
2. In these Regulations— | ||
“Regulations of 2023” means European Union (Road Transport) (Working Conditions and Road Safety) (Amendment) Regulations 2023 ( S.I. No. 567 of 2023 ); | ||
“Principal Regulations” means European Union (Road Transport) (Working Conditions and Road Safety) Regulations 2017 ( S.I. No. 229 of 2017 ). | ||
3. Regulation 2(1) of the Principal Regulations is amended by substituting for the definition of “First Council Regulation” (inserted by Regulation 3(a)(i) of the Regulations of 2023) the following: | ||
“ ‘First Council Regulation’ means Council Regulation 561/2006 of the European Parliament and of the Council of 15 March 20061 , as amended by Regulation (EC) No. 1073/2009 of the European Parliament and of the Council of 21 October 20093 , the Second Council Regulation, Regulation (EU) 2020/1054 of the European Parliament and of the Council of 15 July 20204 and Regulation (EU) 2024/1258 of the European Parliament and of the Council of 24 April 20242 ;”. | ||
4. The Principal Regulations are amended— | ||
(a) in Regulation 41(1)(a), by substituting “16(2), (3), (4)(a) or (4)(b)” for “16(2) or (3)” (inserted by Regulation 24(a) of the Regulations of 2023), and | ||
(b) in Regulation 44(1)(b), by inserting “16(4)” after “12,”. | ||

EXPLANATORY NOTE | ||

The purpose of these Regulations is to amend the European Union (Road Transport) (Working Conditions and Road Safety) Regulations 2017 ( S.I. No. 229 of 2017 ) in line with the amendments made to Regulation (EC) 561/2006 by Regulation (EU) 2024/1258 of 24 April 2024 in regards to minimum requirements on minimum breaks and daily and weekly rest periods in the occasional passenger transport sector. | ||
