I, EAMON RYAN, Minister for the Environment, Climate and Communications, in exercise of the powers conferred on me by section 8 (2) of the Sustainable Energy Act 2002 (No. 2 of 2002), having consulted with the Minister for Public Expenditure, National Development Plan Delivery and Reform and the Sustainable Energy Authority of Ireland, and for the purpose of giving further effect to Regulation (EU) 2016/1952 of the European Parliament and of the Council of 26 October 20161 , and Regulation (EC) No 1099/2008 of the European Parliament and of the Council of the 22 October 20082 , hereby order as follows:

1. This Order may be cited as the Sustainable Energy Act 2002 (Section 8(2)) (Conferral of Additional Functions - Reporting of National Energy Statistics and Electricity and Natural Gas Prices) Regulations 2024.

2. In this Order-

“competent authority” means-

(a) In relation to data concerning energy products and their aggregates, a body established by or under statute or a Department of State which collects, compiles, analyses or otherwise for any purpose uses data concerning energy products and their aggregates, and

(b) In relation to data concerning natural gas and electricity prices, a body established by or under statute or a Department of State which compiles data on natural gas and electricity prices, including, but not limited to, their components and sub components concerning network costs, taxes, fees, levies and charges and on consumption volumes;

“supplier” means-

(a) In relation to electricity, the holder of a licence under section 14(1)(b) or (h) of the Electricity Regulation Act 1999 (No. 23 of 1999), and

(b) In relation to natural gas, the holder of a licence under section 16(1)(a) of the Gas (Interim)(Regulation) Act 2002 (No. 10 of 2002).

“undertaking” means –

(a) A producer or trader of primary or transformed energy;

(b) A distributor or transporter, including importers or exporters, of energy products;

(c) Final energy users.

3. The following additional functions in relation to the reporting of statistics are conferred on the Sustainable Energy Authority of Ireland:

(a) To collect data from a competent authority and from electricity and natural gas suppliers on gas and electricity prices in accordance with the requirements of Regulation (EU) 2016/1952 of the European Parliament and of the Council of 26 October 2016 on European statistics on natural gas and electricity prices.

(b) To collect data from a competent authority and from undertakings concerning energy products and their aggregates in accordance with the requirements of Regulation (EC) No. 1099/2008 of the European Parliament and of the Council of 22nd October 2008 on Energy Statistics.

(c) The Sustainable Energy Authority of Ireland shall have the power to issue Directions to a competent authority, electricity and natural gas suppliers and undertakings in order to perform its data collection functions pursuant to Regulation (EU) 2016/1952 of the European Parliament and of the Council of 26 October 2016 on European statistics on natural gas and electricity prices and Regulation (EC) No. 1099/2008 of the European Parliament and of the Council of 22nd October 2008 on Energy Statistics.

This S.I. pertains to the conferral of additional functions on the Sustainable Energy Authority of Ireland (SEAI). The functions being assigned to SEAI relate to requirements under Regulation (EU) No 2016/1952 of the European Parliament and of the Council of 22 October 2008 on European statistics on natural gas and electricity prices and repealing Directive 2008/92/EC and to requirements under Regulation (EC) No 1099/2008 of the European Parliament and of the Council of 22 October 2008 on energy statistics.
