I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 19 of 1993) and, in relation to paragraph 1 of the Schedule to the following Order, for the purpose of giving full effect to Regulation (EC) No. 1099/2008 of the European Parliament and of the Council of 22 October 20081 , as amended by Commission Regulation (EU) No. 844/2010 of 20 September 20102 , Commission Regulation (EU) No. 147/2013 of 13 February 20133 , Commission Regulation (EU) No. 431/2014 of 24 April 20144 , Commission Regulation (EU) 2017/2010 of 9 November 20175 , Commission Regulation (EU) 2019/2146 of 26 November 20196 , and Commission Regulation (EU) 2022/132 of 28 January 20227 , in so far as it relates to Annex B thereto, hereby order as follows: | ||
1. This Order may be cited as the Statistics (Business Energy Use Survey) Order 2024. | ||
2. (1) In these Regulations — | ||
“Regulation” means Regulation (EC) No. 1099/2008 of the European Parliament and of the Council of 22 October 20081 , as amended by Commission Regulation (EU) No. 844/2010 of 20 September 20102 , Commission Regulation (EU) No. 147/2013 of 13 February 20133 , Commission Regulation (EU) No. 431/2014 of 24 April 20144 , Commission Regulation (EU) 2017/2010 of 9 November 20175 , Commission Regulation (EU) 2019/2146 of 26 November 20196 , and Commission Regulation (EU) 2022/132 of 28 January 20227 ; | ||
“survey” means the Business Energy Use Survey that is conducted by the Central Statistics Office for the purposes of obtaining information specified in the Schedule, including for the purposes of compliance with the Regulation, in so far as it relates to Annex B thereto. | ||
(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, other than where the context otherwise requires. | ||
3. This Order applies to a person who, or an undertaking that, is classified for statistical purposes under any section of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20068 , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 20089 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 201210 , and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 201911 . | ||
4. A requirement on persons to whom, or undertakings to which, this Order applies to provide, once only and for the purposes of the survey, information the general nature of which is specified in the Schedule in relation to each year in the period from 2023 to 2027, is hereby prescribed. | ||
5. The Statistics (Business Energy Use Survey) Order 2018 ( S.I. No. 509 of 2018 ) is revoked. | ||
SCHEDULE | ||
Article 4 | ||
1. Information regarding the following, as it relates to the business activity of the person or undertaking concerned, and specifying the year to which the information relates: | ||
(a) quantity of energy product used; | ||
(b) quantity of energy product purchased; | ||
(c) where self-generated electricity was produced, the quantity of the self-generated electricity by source. | ||
2. Information regarding the following, as it relates to the business activity of the person or undertaking concerned, and specifying the year to which the information relates: | ||
(a) cost of energy product used; | ||
(b) cost of energy product purchased; | ||
(c) where self-generated electricity was produced, the value of the self-generated electricity; | ||
(d) amount of self-generated electricity sold on the electricity grid, by quantity; | ||
(e) amount of self-generated electricity sold on the electricity grid, by value. | ||
3. Information on the time taken by the person or undertaking concerned to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraphs 1 and 2. | ||
